Planning Assessment Report Page 20 300 Kennedys Road, Lake Macdonald QLD 4563 – Extractive Industry 3.5 Local Planning Instruments 3.5.1 Planning Scheme The Noosa Shire Planning Scheme (“Planning Scheme”) provides a framework for managing development. The Planning Scheme divides the Noosa Shire into nine (9) localities which are further divided into zones. Overlay Maps further assign possible land and development capabilities or constraints. In addition, the Planning Scheme sets objectives for development in each zone and overlay type. Development is managed in accordance with implementation criteria directed to satisfy the set objectives. 3.5.2 Definition Part 2, Section 2.11 of the Planning Scheme outlines and defines “use classes”, “uses” and “administrative definitions”. Extractive Industry is contained within the “Industrial Business” (use class) and is identified as “Type 3 – Extractive” (use) within the Planning Scheme. Under the Planning Scheme “Industrial Business” is defined as: “means the conduct of an industrial business activity, where goods or products are produced, manufactured, dismantled, altered, repackaged, repaired or stored at a scale of greater than that defined by retail business. The use includes the sale of goods, resulting from such operations, provided that sales space does not exceed 20% of the use area. Any space dedicated for administration or accounting work in connection with such operations does not exceed 20% of the use area. The term includes the following types: … Type 3 Extractive – winning of the land (or the bed of a watercourse) gravel, rock, sand, soil, stone, or other similar materials. The use class includes the treatment of those materials to produce a varied product. The term does not include the use of premises for an activity authorised under the Mineral Resources Act 1989.” 3.5.3 Zoning The Planning Scheme divides the Noosa Shire into nine (9) localities which are further divided into zones. Certain zones incorporate precincts. The Site is located within the “Rural Zone” of the “Cooroy & Lake Macdonald Locality” (refer FIGURE 5 – ZONING MAP). 3.5.4 Overall Outcomes The Overall Outcomes and comments relevant to the proposal for the Cooroy and Lake Macdonald Locality are addressed as follows: a) New uses and works are located, designed and managed to – i. be compatible with other uses and works; ii. maintain the safety of works; iii. avoid significant adverse impacts on the amenity enjoyed by users of other premises, including acoustic and visual qualities; and iv. avoid significant adverse effects on the natural environment, including native habitat removal, fragmentation and attrition; RESPONSE: The proposed development for extractive industry is no different to the historical mining activities over the land. The only difference to the historical mining activities over the land in comparison to this application for extractive industry is that the extraction of the clay material will be used for its physical properties as fill (e.g. for rehabilitation purposes for the Neales December 2012 / file ref. 1271_DA1_310_001 GROUNDWORK p l u s
