Plan of operations for level 2 mining projects

The holder of a level 2 environmental authority (mining lease) must, under s. 233 of the Environmental Protection Act 1994
(EP Act), submit a copy of this plan of operations to the relevant office of the administering authority at least 28 days before
carrying out a mining activity on the relevant mining leases, unless a shorter period is agreed in writing by the administering
authority.

Plan of operations

The Environmental Protection Act 1994 requires that every level 2 mining project that includes a mining lease
must be covered by a current plan of operations.

This standard plan of operations is fo be completed and submitted to the administering authority to satisfy that
requirement.

The plan may relate to one or more mining leases in a project and may apply for a period that you specify of up
to five (5) years. Where the plan of operations applies to two or more leases, each lease must be shown on a
separate site plan.

The plan must be accompanied by an environmental audit statement and the fee prescribed under a regulation.

The holder may amend or replace the original plan of operations at any time before the plan period ends.
However, an amendment must not extend the plan period.

Financial assurance

A financial assurance must be lodged with the District Mining Registrar, Department of Employment, Economic
Development and Innovation (DEEDI) before any work can commence on the project.

You cannot lawfully mine unless you have lodged a financial assurance to guarantee the satisfactory
rehabilitation of the areas disturbed by mining.
