                             Decision Evidence and Findings

Findings on material questions of fact:

 The objective of the Transport Infrastructure Act 1994 (TIA) requires establishment of a
road regime that is safe and efficient.
 Section 62 of the TIA provides for the Chief Executive of the Department of Transport
and Main Roads to make decisions about permitted road access locations between
particular land and a state-controlled road.
 The development application (Council reference: RAL21/0022) seeks a Development
Permit for Reconfiguring a lot (1 into 6) residential lots.
 The proposed development on Lot 4 SP320405 seeks to gain access to Reserve Street a
state-controlled road, via the existing private road Triller Court and access location for
     the site.
 The existing access is not associated with a decision under section 62 of the TIA.
 Access via a local road is not available.
 The Traffic Assessment Report and related correspondence submitted as part of the
response to further advice has demonstrated turn treatments can be provided at the
access location to improve the safety and operating conditions of the existing access.
Relocation of the existing power pole adjacent to the southbound lane of Reserve Street
is required to ensure safe distance between the power pole and the BAR turn treatment
     is achieved.
 The proposed development can be conditioned to provide Basic Left Turn (BAL) and
Basic Right Turn (BAR) treatments with relocation of the existing power pole to ensure
the development can be effectively implemented without significant impacts to the safety
and efficiency of the state-controlled road network with the conditioned requirements.
