Background
3 Multiple Dwelling Units (TPC 109) received Council approval in May 1971, however the proposal was not acted on and lapsed.
Council records do not indicate when the existing dwelling house was constructed.
Site Description
The subject site is of an irregular shape comprises an area of 511m2. Furthermore, the subject site falls from north to south at a gradient of 20%. A dwelling house and dense and mature vegetation currently exist on the property. Access to the property is gained via a crossover driveway from Edwards Street Strip East.
Surrounding Land Uses
The surrounding land uses of the subject site comprise a mix of dwelling houses and dual occupancies to the north, east and south. The David Low Way and associated road reserve is located to the west of the subject site.
assessment
Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017; and
Noosa Plan 2020.
Noosa Plan 2020
The following codes from the Noosa Plan 2020 are applicable to this development:
Medium Density Residential Zone Code;
Coastal Communities Local Plan Code;
Dual Occupancy and Multiple Dwelling Code; and
Works Codes.
The subject site is located in Sunshine Beach and is zoned Medium Density Residential. The proposed Dual Occupancy is identified as a consistent use within the zone and is required to follow a code assessable application process.
The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below:
Criteria	Planning Scheme	Proposal	Complies

Setbacks
Acceptable Outcome AO12.1 of the Medium Density Residential Zone Code required buildings and structures are setback 6 metres from the rear boundary and 0.75 metres from the southern side boundary. The proposed dual occupancy is setback 4.6 metres at the outer most projection of the building to the rear boundary. The proposal therefore does not comply with Acceptable Outcome AO12.1 and is assessed against Performance Outcome PO12.
Performance Outcome PO12
Buildings and structures are designed and sited to:
provide a high level of amenity to users of the subject site and adjoining premises, including provision of visual and acoustic privacy;
not unreasonably obstruct views or cause overlooking of private open space or habitable areas of adjoining premises;
provide adequate distance from adjoining land uses;
preserve existing vegetation that will help buffer development;
allow for space and landscaping to be provided between buildings including adequate area at ground level for landscaping with trees, shrubs, outdoor living and utilities;
be consistent with the predominant character of the surrounding area; and
protect the natural character and avoid adverse impacts on ecologically important areas such as national parks, waterways and wetlands.
Rear Setback
The proposed setback intrusion is demonstrated in Figure 7 & 8 which predominately comprises of the roof which provides shade to the upper floor balcony. The proposed upper floor balcony and balcony roof provide a high level of amenity to users of the subject site by acting as covered private open space. Notably, the proposed upper-level balcony is 4.5 metres high, whilst the roof is 6.9 metres in height. Moreover, the section of the upper floor balcony and roof located within the 6 metre rear setback are setback approximately 10 metres from the adjoining property to the rear. When the 20% gradient of the site is considered, the private open space of the adjoining property to the rear is located 1 metre below the balcony. Notwithstanding, the 1.8-metre-high rear fence and existing vegetation will mitigate the potential to cause overlooking of private open space or habitable areas of adjoining premises. A condition of approval has been included to address privacy should it cause nuisance in the future, however it is noted that the net difference between where the deck is lawfully setback and where it encroaches is minor.

Figure 7 – Rear setback encroachment (roof)

Figure 8 – Rear setback encroachment (balcony)
Furthermore, the existing dwelling is setback 4 metres from the rear boundary. Refer to Figure 9. The proposed 4.6 metre setback is therefore considered an improvement on the existing development. Notwithstanding, a condition requiring the balcony to be screened has bene included in the conditions of approval.

Figure 9 – Existing Rear Setback Encroachment (balcony)
The proposal is located approximately 10 metres from the adjoining dwelling, which is considered an adequate distance. The 4.6 metre setback encroachment for a section of the balcony maintains an average 6 metres setback which therefore allows for space and landscaping to be provided between budlings, noting that a condition is to be included which specifies screening vegetation must be provided adjacent to the rear property boundary. The proposed setback encroachment therefore complies with Performance Outcome PO9.
Side Setback
The proposed southern wall encroaches into the southern side boundary setback by 0.75 metres and is highlighted in Figure. The dual occupancy responds to the irregular shaped site and the setback intrusion is considered minor. The section of the building within the setback does not contain windows or openings which therefore diminishes the opportunity for overlooking. Furthermore, Figure 10 demonstrated that the existing dwelling is located on the southern property boundary. The proposal is therefore considered an improvement on the existing setback and complies with Performance Outcome PO9.

Figure 9 – Southern side setback encroachment

Landscaping
Application for a Material Change of Use for a Dual Occupancy application at 164 Edwards Street, Sunshine Beach. The proposed development site is 512m2 with the existing use being a dwelling. The proposed development is assessed under the:
Medium Density Residential Zone within the Sunshine Beach locality
Coastal Communities Local Plan Code
Dual Occupancy and Multiple Dwelling Code
Works Code
The proposed development meets the required landscaping volume requirement of 40% under the Noosa Plan 2020 with a proposed 42% or 220m² landscaped area.
Species not achieving the appropriate mix of native and endemic plants selected were identified during the information request stage with an amended plan provided. The amended plans did not substitute species are requested with the following plants not included within the Noosa Plan 2020 – PSP Landscaping Preferred Plant List:
Star Jasmine;
Bromeliad; and
Blue Chalk Stick plant.
Landscaping treatments including dense planting are proposed (as represented in plan WD.2.07) to create a landscaped setting and positively contribute to the streetscape. A variety of trees, shrubs and ground covers are proposed which will achieve a varied landscaped outcome.
