RE: OBJECTION TO MCU 16/0153 REC16/0041
AT 215 DAVID LOW WAY, PEREGIAN BEACH
By local residents and Peregian Beach commercial property
owners Peter Currey and Sharyn Kerrigan

It is incredibly disappointing to think that the Noosa Town Plan
would not be able protect the unique character of one of it’s
small Coastal Villages from a proposal for more suburban
housing sprawl on land set aside for significant community
purpose. Open Space Recreation zoned land is incredibly
valuable to both the character of the regional town and as
public amenity to drive a diverse economy for the local business
centre.
There has been great concession given to the owner of the land
already for approval to build a Supermarket complex on the
Open Space Recreation zoned property.

                                                                  1

Page 5

NON COMPLYING USE

Adding a ‘permanent housing estate’ onto this land will not
provide for the growing need of the local community.
The Town has many new small lot housing developments being
built around it that drawn on Peregian Beach for their public
amenity and open space.

From Applicant’s Site Plan

The proposed private road of tightly space concrete driveways
and garage door frontages, we considered, would produce the
most uncomfortable pedestrian thoroughfare between the
supermarket & Rufous St.

We strongly object to the inclusion of the housing estate in
this proposal, but in particular the lack of visitor
accommodation being provided as required by the Noosa Plan.

                                                                2

Page 6

INTREGRITY OF TOWN PLAN & LOCAL ECONOMY

As Commercial Property Owners & Residents of Peregian Beach,
we believe it is essential to protect and retain the remaining
part of this site for open space visitor accommodation that
reflects the site’s previous use as a caravan park that gave the
village it’s casual coastal character that makes the commercial
precinct so popular.

This owner- developer has done the Commercial Centre a
disservice for the past 7 or 8 years by depriving the local
community of any visitor accommodation or open space
recreational facilities on the property since closing the
caravan park and continually applying for modification of
prior approvals.
We do not support the process of breaking up the one parcel of
land into staged developments. This is one application and should
be rejected or approved as one application.

Prior application

                                                                3

Page 7

CHARACTER & COMMUNITY AMENITIES

The proposal of a small lot housing estate as shown in this
proposal would only put more pressure onto the existing village
public amenities and provide absolutely no contribution to the
character of the Commercial Centre. If anything it will make it
feel just like any other suburb which will endanger the unique
character that attracts visitors & sustains the local economy.

From appliants shadow diagrams drawings

It is essential to retain and protect the zoning given by the
Noosa Plan for the rest of this site.
It is understood the previous Development Approval on the site
has lapsed, which provided purely for visitor accommodation.

                                                                 4

Page 8

PRO-DEVELOPMENT FOR COMMUNITY BENIFIT
If the developer was to seek out the actual needs of the local
community instead of producing these reports of rhetoric to
support a housing development, he may find there would be no
objection to a design concept that merged the proposed Motel
Visitor accommodation with a North oriented Aged Care
Accommodation Complex, if greater open space parkland
connection was provided to the neighbouring Community
Kindergarten, Little Rufous Creek and community recreational
facilities.

Marked up site plan

                                                                 5

Page 9

CONNECTING WITH ADJOINING COMMUNITY

The proposed development turns its back on the Rufus Street,
and the laneway, which is not a desirable town planning
outcome. In fact it is insulting to the successful Community
Consultation and Master plan process Noosa Council recently
undertook.

Rufous Street Master Plan

The proposed development is not consistent with the Rufous
Street Master Plan for the locality, which has been adopted by
the Council, following extensive community consultation.
This master plans seeks to activate the laneway and provide for
a pedestrian friendly entry point and high level of visual
amenity at this location. Further, any development should make
provision for pedestrian access/cycle way through the parkland
to the west.

                                                               6

Page 10

It is horrifying to imagine what the proposed new dwellings with
it’s commercial outlets on to the Rufous Recreation precinct will
do to the pocket rainforest & fresh water creek that borders
the boundary of this parcel of land and is the focal point of the
public laneway design undertaken with Sparks Architects
and currently under construction. The proposed fill & incredibly
small rear setback of the dwellings to the north Boundary bears
not relationship to the existing natural vegetation and overland
water flow.

                                                               7

Page 11

It is easy to see the staff & customers of these proposed
commercial premises would utilizing the parking spaces in
Rufous precinct which will only further reduce the availability
of parking for traders & patrons of the existing Commercial
centre. The pressure for more parking spaces has already
compromised the existing Rufous Recreation Open Space.

It is also easy to foresee that visitors of any such housing
estate, for convenience, would also use Rufous street for
parking rather than go through the entry of the property and
the labyrinth of internal roads that are shared with a
Supermarket & Motel complex.

                                                                  8

Page 12

TRAFFIC CONFLICT WITH STAGE 1
The Stage 1 Supermarket road entrance off Sandpiper Lane is
already congested by the layout of the supermarket car park
entrance/exit. The traffic report in this proposed stage 2
works fails to include the impact of the Supermarket traffic
flow on this proposal. This could be very detrimental to the IGA
& new shopping centre patronage even before taking in the
additional traffic entering David Low Way.

From applicant’s Traffic Report

                                                               9

Page 13

The proposed development significantly conflicts with the Noosa
Plan for the following reasons:
   • The proposed development being located within the Open
Space Recreation Zone does not contribute to the desired
lifestyle of residents because it does not offer a variety
of passive and active recreational experiences that are
      conducive to community interaction and wellbeing;
   • The proposed development seeks to provide a small lot
housing development and in particular, Multiple Housing
Type 4 – Conventional which is not a consistent use in the
      Open Space Recreation Zone;
   • The proposed development seeks to provide Visitor
Accommodation Type 4, but not in association with Visitor
Accommodation Type 2, and therefore is not consistent
      with the Open Space Recreation Zone;
   • The proposed development does not protect the Peregian
Beach caravan park site for low cost visitor
      accommodation;
   • Visitor Accommodation Type 4 is being proposed on the
land, but is not integrated as part of a caravan park use
      or other form of budget accommodation;
   • The proposed buildings and structures are not designed
and sited to be attractive, comfortable and accessible to
the public or provide suitable landscape treatments and
amenities, conducive to community interaction and
      convenience and public safety;
   • The proposed development is not consistent with the
reasonable expectations of residents in the locality, given
the Peregian Beach Caravan site is to primarily provide for
budget visitor accommodation, which is in the public
      interest;
   • There are no grounds provided that are sufficient to
overcome the level of conflict identified with the Noosa
      Plan.
The proposed development application should be refused for the
above reasons.
