Attached to the e-mail Superseded Planning Scheme Request - 139 Eumundi Noosa Road.

Wednesday, 25 October 2017 Our Ref: DF14124 / Office: Sunshine Coast Council Ref: MCU14/0102 NOOSA COUNCIL PO BOX 141 TEWANTIN QLD 4565 ATTENTION: The Chief Executive Officer Dear Sir MAKING A SUPERSEDED PLANNING SCHEME REQUEST 139 EUMUNDI NOOSA ROAD, NOOSAVILLE LOT 2 ON SP294726 Pursuant to section 29 of the Planning Act our client, the applicant, makes this request for a superseded planning scheme to apply to a proposed development application on the above land. The proposed development is for a pylon sign on Lot 2 SP294726 at 139 Eumundi Noosa Road, Noosaville. The proposed pylon sign is defined as a “freestanding sign” under Council’s Advertising Devices Code and is triggered to code assessable under the applicable Assessment Table in the Noosa Plan by virtue of non-compliance with the specified requirements for accepted development. The applicable superseded planning scheme in this case is the version of the Noosa Plan that existed immediately prior to 28 October 2016 when Amendment No. 6 took effect (ie. the 16 September 2013 version or Amendment No. 5). Preamble th On the 12 September 2016, my client and I met with Council’s Glen Conforti (Development Planner) to discuss the prospect of getting support from Council for an additional pylon sign for the subject allotment, fronting Walter Hay Drive. Amongst other things, Mr Conforti advised that a pylon sign on the Walter Hay Drive frontage would be self-assessable, once the approved reconfiguration (REC15/0032) occurred, and as long as it meets the self-assessable criteria set out in Council’s Advertising Devices Code. Mr Conforti was the assessment manager for the various applications over the subject site and would have been aware of the conditions under the higher order MCU & OPW (signage) approval (MCU14/0102), which amongst other things, required that “no pillar sign is permitted along Walter Hay Drive”. Mr Conforti did not discuss the conditions of the existing approval, not their potential effects on developing a pylon sign on the Walter Hay Drive frontage. Confirmation of Council’s advice was sought in writing via email on 15 September 2016 and Mr Conforti subsequently responded that same day stating:- “I confirm that a (1) pylon sign on the Walter Hay drive frontage would be self-assessable against the Advertising Devices Code, after REC15/0032 is sealed and the lot created. “ A copy of the email from Mr Conforti is attached.

Section 2
At no time did Mr Conforti mention or make us aware that the Advertising Devices Code was set to be
substantially amended on 28 October 2016, including amendments that would remove the “self-
assessable” provision allowing one freestanding sign per frontage. The applicant would have likely
taken a different approach to the development of the proposed pylon sign had they been made aware
of this pending change to the ‘rules’.
Our client took certain actions in respect to the proposed sign off the back of this advice from Council,
including having the sign built and making provision on site for the sign, at significant cost (circa
$50,000 for the cost of building the sign). In addition, in reliance upon advice from Council, our client
made commitments to tenants on the site regarding their entitlement to such signage. Accordingly, if
Council does not approve the proposed sign, our client will stand to suffer significant loss. It is for this
reason that the applicant has been forced to make this request for assessment under the superseded
planning scheme.
In accordance with section 29(5) of the Planning Act and section 11 of the Planning Regulation 2017
the following requisite information is provided:
the name, residential or business address, electronic address and phone number of the person
making the request is as follows:
Name of Applicant Address Email Phone
Inline Property C/- Peter Folker, Project Urban, PO [email protected] 5443 2844
Development P/L TTE Box 6380 Maroochydore BC Qld
4558
the address or property description of the premises is provided above;
the applicant is asking the local government to accept, assess and decide a superseded planning
scheme application;
a copy of the proposed Site Plan and Sign Elevation is included at Attachment B;
a copy of the proposed superseded planning scheme application accompanies this request at
Attachment C; and
the applicable fee will be paid once Council issues the request for payment.
We note that Noosa Council does not have a form for a SPS request – hence, no form has been
provided.
Proposed Development
The proposed development which is the subject of this superseded planning scheme request is a 5m
high, freestanding pylon sign fronting Walter Hay Drive. The location of the proposed sign is
identified on the accompanying Site Plan, prepared by Powe Architects (refer Attachment B). Details
of the proposed sign, including dimensions and indicative signage elements, are shown on the
accompanying Proposed Sign Elevation prepared by Metro Signs (refer Attachment B).
A more detailed description and assessment of the proposed sign is set out in the development
application material in Attachment C.
Deciding Superseded Planning Scheme Request
We note that pursuant to section 29(6) of the Act, Council must decide whether or not to agree to a
superseded planning scheme request within 30 business days after the request is received, unless
extended by agreement with the applicant.

Hi Glen
I appreciate your time and advice you gave on Monday in relation to the above property.
As discussed, can you please confirm your advice from the meeting that a pylon sign on the Walter Hay
Drive frontage would be self-assessable, once the approved reconfiguration (REC15/0032) occurs, and as
long as it meets the self-assessable criteria set out in Council’s Signage Code.
That is, as long at the pylon sign is the only freestanding sign on that frontage, and it does not exceed 5m
in height, and does not have a sign face area that exceeds 4m2 per side…it would be deemed self-
assessable?
Please contact me if you need any further information to respond.
Thanks and regards
Peter

LOT 2 ON SP294726
This Development Application for Operational Works (Signage) accompanies a request to Council for a
superseded planning scheme to apply to the application on the above land.
This application is required to accompany the superseded planning scheme pursuant to section
29(5)(b) of the Planning Act.
In respect of this development application, please find included and attached:
DA Form 1;
A description of the proposed signage (below);
Relevant plans identifying the site and the proposed development (Attachment 1);
An assessment below addressing the applicable assessment benchmarks (below);
A Visual Assessment by Carl Safstrom of Project Urban (Attachment 2); and
Registered plan showing easements on the lot (Attachment 3).
Once Council confirms it will agree to assess the application under the superseded planning scheme, I
will arrange for the application fee to be paid.
Subject Site
The subject site is described as Lot 2 SP294726 and is located at 139 Eumundi Noosa Road, Noosaville
– refer Figure 1 below.
Section 13
Figure 1 – Subject Site
Proposed Signage
Our client proposes to erect a freestanding pylon sign on the site’s frontage to Walter Hay Drive. The
details of the proposed pylon sign and its proposed location is illustrated on the attached proposal
plans by Metro Signs and Powe Architects (refer Attachment 1).
As the plans show, the proposed pylon sign is intended to be a 5m high freestanding sign displaying
tenancy signage. In terms of scale, this sign contains approximately 8.3m2 of sign face area.
The accompanying site plan by Powe Architects identifies the proposed location of the proposed pylon
sign. In this regard, the plans shows that the sign fronts Walter Hay Drive and is set back
approximately 0.6m from the boundary. The verge widens at this location
Applicable Assessment Benchmarks
The 16 September 2013 version of the Noosa Plan specifies that an application for the placing of an
advertising device on premises, where not associated with a material change of use, that is triggered to
Code Assessment is to be assessed against the Advertising Devices Code. Accordingly, the following
sections address the relevant parts of this code.
Those particular provisions that are applicable and are considered material to this assessment are
discussed below.

c) are limited to 1 sign per frontage.
Therefore, an assessment against the Specific
outcome has been undertaken and is set out
below.
In light of the above-mentioned non compliances with Acceptable solutions, the proposed
freestanding sign has been assessed against the corresponding Specific outcomes as set out below.
“Specific outcome O2” is the higher order assessment criteria for Acceptable solution 2.7 and 2.7 which
states:
O2 Advertising devices—
a) are compatible with the human-scale and character of the locality in which they are
situated;
b) are compatible with the scale, proportion, bulk and other characteristics of buildings,
structures and landscaping; and
c) are designed, sited and integrated so as not to contribute to the proliferation of visual
clutter.
Comment
A visual assessment has been undertaken Carl Safstrom of Project Urban (refer Attachment 2), who is
a registered landscape architect and suitably qualified to undertake such an assessment. Mr Safstrom
has specifically addressed this Specific outcome in his assessment report and concludes that:
a) The pylon sign at 5m in height is consistent in size and character of other signage along
Eumudi Noosa Road near the proposed location.
3
Section 15
b) At 5m high the sign is not out of scale with the 10m high building behind or tall vegetation
around and behind the proposed sign.
c) The sign is sited around the corner from other similar signage in this location assisting in
reducing the proliferation of visual clutter along Eumundi Noosa Road.
“Specific outcome O6” is the higher order assessment criteria for Acceptable solution 6.3 which states:
O6 Advertising devices respect the scale and nature of surrounding development and
contribute positively to the visual amenity, streetscape, landscape setting and natural
and built environment of where the advertising device is placed.
Comment
Carl Safstrom has also addressed this Specific outcome in his visual assessment report and in regard to
the above criteria, he concludes that:
The proposed signage is consistent with the scale of the built form and use of the site. The
proposed signage is consistent with the surrounding commercial streetscapes and built
environment. The proposed sign is the only sign along the North Eastern frontage.
Professionally constructed the sign maintains the generally high level of presentation of
signage in this locality.
Conclusion
Following our review of the applicable assessment benchmarks, and together with the findings from
the Visual Assessment by Carl Safstrom of Project Urban, it is concluded that the proposed sign can be
supported and is appropriate development on this site.
Should you have any questions with respect to the above, please do not hesitate to contact me direct.
Yours faithfully
