Wednesday, 25 October 2017 Our Ref: DF14124 / Office: Sunshine Coast Council Ref: MCU14/0102 NOOSA COUNCIL PO BOX 141 TEWANTIN QLD 4565 ATTENTION: The Chief Executive Officer Dear Sir MAKING A SUPERSEDED PLANNING SCHEME REQUEST 139 EUMUNDI NOOSA ROAD, NOOSAVILLE LOT 2 ON SP294726 Pursuant to section 29 of the Planning Act our client, the applicant, makes this request for a superseded planning scheme to apply to a proposed development application on the above land. The proposed development is for a pylon sign on Lot 2 SP294726 at 139 Eumundi Noosa Road, Noosaville. The proposed pylon sign is defined as a “freestanding sign” under Council’s Advertising Devices Code and is triggered to code assessable under the applicable Assessment Table in the Noosa Plan by virtue of non-compliance with the specified requirements for accepted development. The applicable superseded planning scheme in this case is the version of the Noosa Plan that existed immediately prior to 28 October 2016 when Amendment No. 6 took effect (ie. the 16 September 2013 version or Amendment No. 5). Preamble th On the 12 September 2016, my client and I met with Council’s Glen Conforti (Development Planner) to discuss the prospect of getting support from Council for an additional pylon sign for the subject allotment, fronting Walter Hay Drive. Amongst other things, Mr Conforti advised that a pylon sign on the Walter Hay Drive frontage would be self-assessable, once the approved reconfiguration (REC15/0032) occurred, and as long as it meets the self-assessable criteria set out in Council’s Advertising Devices Code. Mr Conforti was the assessment manager for the various applications over the subject site and would have been aware of the conditions under the higher order MCU & OPW (signage) approval (MCU14/0102), which amongst other things, required that “no pillar sign is permitted along Walter Hay Drive”. Mr Conforti did not discuss the conditions of the existing approval, not their potential effects on developing a pylon sign on the Walter Hay Drive frontage. Confirmation of Council’s advice was sought in writing via email on 15 September 2016 and Mr Conforti subsequently responded that same day stating:- “I confirm that a (1) pylon sign on the Walter Hay drive frontage would be self-assessable against the Advertising Devices Code, after REC15/0032 is sealed and the lot created. “ A copy of the email from Mr Conforti is attached.
