APPLICATION DETAILS Application No. 51993.575.01 Street Address: Vista Alegre 1/11, 2/11 and 11 Ventura St Sunrise Beach Qld 4567 Real Property Description: BUP 13368, Lot 1 and Lot 2 on BUP 13368 Planning Scheme: Noosa Plan 2020 (25 September 2020) 2. INFORMATION REQUIRED The information requested is set out below: Issue – Setbacks AO12.1 of the Medium Density Residential zone Code details that buildings and structures are to meet the following side boundary setbacks: (b) for side boundaries— 1. 1.5 metres setback up to 4.5 metres height; 2. 2 metres setback between 4.5 metres and 7.5 metres height; and 3. 2.5 metres where above 7.5 metres height. (c) for the rear boundary – 6 metres A review of the proposal plans indicates that the new landing and new front deck are 4.98 metres in height which results in the upper screening and roof line intruding into the setback area. The upper level intrusion at the front of the site is not supported. The planning report includes justification for the pool structure in the rear setback however further soft landscaping and a reduction in the overall size is recommended to achieve compliance with the Performance Outcome. Information Required 1. Provide amended plans that demonstrate compliance with side boundary setbacks for the new landing and front deck area. 2. Provide amended plans that detail additional soft landscaping along the rear boundary and a reduced size of the pool structure. RESPONSE * AO’s are only one way to meet the PO’s – not the only way. Assessment is against the PO’s with Code Assessment. * Please refer to the Amended Plans * Pool structure is a class 10a structure – non habitable, with accepted setback in the QDC. * The pool house provides privacy and also screens the onsite stormwater retention tanks required. * Rear boundary Landscaping will also improve as part of the development. Refer to supporting landscaping plans. Issue- Setback Carparking A)12.2 of the Medium Density Residential Zone Code states: AO12.2 The front 6 metres of the property is landscaped open space, provided that uncovered visitor parking, or swimming pools protruding no more than 1 metre above the ground level, can be as close as 2 metres from the front boundary. The proposal plans detail the provision of 2 uncovered carparking spaces within the front 6 metre setback and on the front property boundary. These spaces do not comply with AO12.2 and are not supported. Information Required 1. Provide amended plans detailing a landscape setback of 2 metres from the front property boundary. RESPONSE * AO’s are only one way to meet the PO’s – not the only way. Assessment is against the PO’s with Code Assessment. * Please refer to the Amended Plans. * Parking arrangements are back to existing. The only change is the approved turning area will now become a dedicated visitor parking space for the Lot 2 Residence. * Both Lots will have visitor parking that will become exclusive use areas for each unit. * Vehicles can reverse out of Dual Occupancies * Vehicle Swept Paths have been demonstrated. Issue – Amenity AO20 of the Medium Density Residential Zone code details requirements relating to overlooking and privacy where there is the potential to overlook or view into habitable windows within 10 metres Information Required 4. Provide further information demonstrating that the new windows and decks will not overlook into the adjoining units. Details to include location of adjoining windows and private open space areas (if applicable) as well materials such as screening or use of opaque window treatments. * AO’s are only one way to meet the PO’s – not the only way. Assessment is against the PO’s with Code Assessment. * Please refer to the Amended Plans and supporting notes in red. Issue - Carparking The proposed double parking bay is located in close proximity to the front boundary and Council has concerns with the functionality of the spaces and their impacts on the ability to access the garage. Information Required 1. Provide vehicle swept paths for the car spaces and garage extending from the road formation to the space. The swept path must be for a B99 vehicle as described in AS/NZS2890.1:2004 and assume that the adjoining and adjacent spaces are occupied RESPONSE * Parking arrangements back to existing. Issue - Stormwater The proposed works will create a significant increase in stormwater runoff from the site. No detail has been provided to indicate how runoff will be controlled and discharged. Information Required 6. Provide a Stormwater Management Plan for the proposed development. The plan must be prepared by a suitably qualified person and demonstrate that the proposed development will not create a worsening for any adjoining property RESPONSE * SWMP has been provided by Bax Engineering. Comments: I request Noosa Accept the amended Stormwater Mg Plan and Landscaping as part of this Other Change DA. Further Operational Works Approvals are double handling and not required. All information requests have been responded to – please continue your assessment and progress to a Decision. Please restart the Clock. Any questions, please email or call.
