Attached to the e-mail MCU23/0007 & RAL23/0001 - SARA advice notice - not properly addressed issues.
GE77-N SARA reference: 2301-33112 SRA Council reference: MCU23/0007 & RAL23/0001 24 February 2023 Radheath P/L TTE c/ - Pivotal Perspective Pty Ltd 4/59 Mary St NOOSAVILLE QLD 4566 [email protected] Attention: Mr Jack Lewis Dear Mr Lewis SARA advice notice - 45 and 47A Maple Street, and 9 Myall Street, Cooroy (Advice notice given under section 35 of the Development Assessment Rules) The State Assessment and Referral Agency (SARA) advises that your development application has not adequately demonstrated compliance with the State Development Assessment Provisions. SARA has reviewed your application material and further to the email sent to you on 14 February 2023, and the phone conversation with you on 24 February 2023, the following issues with the proposed development have been identified: Stormwater 1. Issue: The proposal has not adequately demonstrated compliance with PO8- PO14 of State code 1: Development in a state-controlled road environment (State code 1). The Stormwater Management Plan, (prepared by Recor, dated 31 March 2021), does not clearly identify any external catchment which may impact on flows towards the lawful point of discharge. Action: To ensure compliance with PO8-PO114 of State code 1, provide an amended stormwater management plan, or other material, that demonstrates how stormwater will be managed, including any external catchments, to achieve a no material worsening impact onto the State-controlled road. Note: The stormwater management plan should identify the external catchments and
ensure these are mitigated on site through the onsite detention tanks before discharging to
the lawful point of discharge.
Noise Impacts
2. Issue:
The proposal has not adequately demonstrated compliance with PO39 - PO42 of State
code 1, by minimising noise intrusion from a state-controlled road in private open space and
habitable rooms. The submitted architectural plans (prepared by Push, dated 2 December
2022), indicate that boundary fencing and balustrades adjacent Myall Street are proposed
as permeable batten balustrades, which has limited ability to minimise noise impacts in
accordance with the requirements of State code 1.
Action
To ensure compliance with PO39 - PO42 of State Code 1, amend the development
proposal plans, to minimise noise intrusion from the state-controlled road consistent with
PO39 - PO42. Plans should clearly identify the proposed height of the fence on the ground
floor.
Advice
3. Any Road Traffic Noise Assessment Report provided should be RPEQ certified (or a
suitably qualified relevant professional) and must be conducted in accordance with
Department of Transport and Main Road’s Road Traffic Noise Management: Code of
Practice, Chapter 4 which is available at www.tmr.qld.gov.au/Business-industry/Technical-
standards-publications.aspx.
Please note that unlike an information request, assessment timeframes do not stop when advice
is provided by SARA.
How to respond
It is recommended that you address these issues promptly and provide a response to SARA by 28
February 2023. If you decide not to respond, your application will be assessed and decided based on the
information provided to date.
Under the Development Assessment Rules (DA Rules), the issuing of advice does not stop the
assessment timeframes. If you intend to provide additional information, it should be provided in a timely
manner to allow sufficient time for the information to be considered. As such, you are strongly
encouraged to consider using the ‘stop the clock’ provisions under s32 of the DA rules, to allow sufficient
time for you to consider and respond to SARA’s advice; and for SARA to consider any new or changed
material provided.
If you wish to utilise the ‘stop the clock’ provisions, you should give notice to the assessing authority
(assessment manager or referral agency) whose current period you wish to stop. This can be done
through MyDAS2 or via correspondence.
You are requested to upload your response using the ‘manage documents’ function in MyDAS2.
