5. REASONS FOR THE DECISION
The reasons for this decision are:
Council decided to refuse the Early Referral agency response application RAP25/0014 for the
following reasons:
1. The proposal does not comply with Overall Outcomes 6.3.1.2 (2) (c) of the Low Density
Residential Zone Code as the development does not make a positive contribution to the
streetscape or result in low scale character as the development at ground level results
in a site cover of 46% and 45% at the first floor which can be minimised through an
alternative design.
2. The proposal does not comply with Acceptable Outcome AO8.1 and corresponding
Performance Outcome PO8 of the Low Density Residential Zone Code as:
a. The proposal will result in a site cover of 45% for the ground level and 46% for
the first floor which significantly exceeds the site cover requirements of the
planning scheme. The scale of the proposed dwelling is excessive and not of a
scale intended under the Low Density Residential Zone.
b. The proposed Dwelling house and Secondary dwelling present as a solid two
storey structure with a length of approximately 35 metres facing Crank Street.
This is inconsistent with the built form of the local area and will present far more
bulk to the street than any other dwellings in the area.
c. The design of the house with separate driveways for the main house and
Secondary dwelling will present to the street a built form more characteristic of
a large duplex than a dwelling house. The proposed driveways will be larger
than shown on the current plans, which increases areas of hardscape along
Crank Street which further detracts from the local streetscape character.
d. The site is a highly exposed corner location at the intersection of four roads and
in an elevated position along Crank street. The development will present
extensive visual bulk and be very dominant and out of character with the
surrounding area.
3. The proposal does not comply with Acceptable Outcome 9.1 (AO9.1) & Performance
Outcome 9 (PO9) of the Low Density Residential Zone Code as the development seeks
a reduced frontage of 0.663m to Crank Street. Given the scale of the house, the reduced
setback will contribute to its building bulk and inconsistency with the predominant low
density character of the streetscape.
4. The proposal does not comply with Acceptable Outcome 9.3 (AO9.3) & Performance
Outcome 9 (PO9) of the Low Density Residential Zone Code as the development seeks
a reduced side setback of 2.03m. The reduced setback would have significant
implications for the neighbouring property to the south in terms of overbearing
development, access to light, air flow and restriction of landscaping opportunities along
the side boundary.
Council decided to refuse the application for the following reasons:
5. The request for a Development permit for Building Work assessable against the planning
scheme DBW25/0034 (carparking) relies on a layout associated with combined Referral
agency response application RAP25/0014 for a Dwelling house (site cover and
setbacks) which is not supported, refer to Referral Agency Matters section of this Notice.

6. The request for a Development permit for Operational works OPW25/0037 relies on a
layout associated with combined Referral agency response application RAP25/0014 for
a Dwelling house (site cover and setbacks) which is not supported, refer to Referral
Agency Matters section of this Notice.
7. The design of the Dwelling house and Secondary dwelling with separate driveways
presents a built form more characteristic of a large duplex than a Dwelling house. The
proposed driveways will be larger than shown on the current plans, which increases
areas of hardscape along Crank Street which further detracts from the local streetscape
character.
There are no relevant reasons to approve the proposed development to vary from
development intensity specified by the Noosa Plan 2020 for this area.
The detailed assessment and reasons for this decision are provided in the assessment
manager’s report, to request a copy of the report please email [email protected]
