Dear Russell,
Information Request
Planning Act 2016
I refer to your application and advise that Council requires further information to satisfactorily
assess the proposal.
1. APPLICATION DETAILS
Application No. MCU26/0047
Proposal: Material Change of Use – Short-Term Accommodation
Street Address: 122 Musa Vale Rd Cooroy Qld 4563
Real Property Description: Lot 304 SP 118015
Planning Scheme: Noosa Plan 2020 (20 March 2026)
2. INFORMATION REQUIRED
Council has reviewed the application material including the Town Planning Report, Site Plans
and Code Assessment.
Pursuant to the Planning Act 2016, further information is required to enable a complete
assessment of the development against the Noosa Plan 2020.
The information requested is set out below:
Item – Existing Short-Term Accommodation Approval
The application relies on the relinquishment of the existing short-term accommodation
approval (SSL25/0041) applying to the main dwelling in order to demonstrate a reduced scale
and intensity of use on the site. However, the application material does not demonstrate a
legally enforceable mechanism to ensure that the existing approval is surrendered or cannot
operate concurrently with the proposed use.

The Planning Scheme seeks to protect the availability of permanent housing and ensure that
short-term accommodation remains subordinate to the primary residential use of land. In the
absence of an enforceable mechanism, there is potential for both approvals to operate
concurrently, resulting in an intensification of use inconsistent with the intent of the Planning
Scheme.
Information Required
1. Provide confirmation of the mechanism by which the existing approval will be
relinquished, cancelled or otherwise prevented from operating concurrently with the
proposed development.
2. Provide a legally enforceable mechanism to ensure that short-term accommodation is
limited to the small dwelling only.
Item - Operational Management of Short-Term Accommodation
The application does not include detail regarding the ongoing operation and management of
the short-term accommodation use.
The Planning Scheme requires that visitor accommodation be operated in a manner that
protects the amenity of surrounding premises and avoids land use conflict. In the absence of
an operational management framework, it is not possible to determine how potential impacts
such as noise, guest behaviour and waste will be appropriately managed.
Information Required
3. Provide an operational management plan for the proposed short-term accommodation
use, including details of:
a. Maximum guest numbers
b. Booking and occupancy arrangements
c. On-site management/contact arrangements
d. Noise management measures
e. Complaints handling procedures
f. Waste storage and collection arrangements
Item - On-site Servicing (Effluent and Water Supply)
The application states that the proposed use will rely on existing on-site effluent disposal and
water supply infrastructure. However, no technical information has been provided to
demonstrate that this infrastructure has sufficient capacity to accommodate short-term
accommodation use.
The Planning Scheme requires that development is provided with a level of infrastructure and
services appropriate to its use that maintains environmental health and public safety.
Information Required
4. Provide certification or supporting documentation confirming that the existing on-site
effluent disposal system:
a. Is approved and operational; and
b. Has capacity to accommodate the proposed short-term accommodation use.
5. Provide details of the potable water supply for the development, including:
a. Tank storage capacity; and
b. Demonstration that the supply is sufficient to meet expected demand.

Item – Bushfire Safety
The site is affected by the Bushfire Hazard Overlay, including land mapped as medium and
high bushfire hazard in close proximity (~ 40 m) to the proposed development and the
application relies on existing siting and infrastructure to achieve compliance. However, further
clarification is required to confirm that the proposed use does not alter the bushfire risk profile
or trigger additional requirements.
The Planning Scheme requires that development maintains an appropriate level of safety for
occupants and facilitates effective emergency response.
Information Required
6. Provide confirmation that the proposed short-term accommodation use does not alter
the bushfire classification of the site or introduce additional applicable building
requirements for the dwelling.
7. Provide a site-specific Bushfire Hazard Assessment and Management Plan that
addresses the bushfire risk associated with the development. The plan should be
prepared in accordance with the Queensland State Planning Policy (SPP) – Natural
Hazards, Risk and Resilience (Bushfire) guidance material, and the Noosa Plan –
Bushfire Hazard Overlay Code. The plan must demonstrate that:
a. Safe access and evacuation can be achieved; and
b. An adequate water supply is available for firefighting purposes. In this regard,
demonstrate that a minimum of 5,000 litres of water is available for firefighting
purposes, in addition to the water supply required for all other uses on the
premises.
3. DUE DATE FOR RESPONSE TO INFORMATION REQUEST
The due date for providing the requested information is 25 September 2026. Email your
response to [email protected]. Please advise Council of your response to this
information request in accordance with section 13 of the Development Assessment Rules.
If you do not provide a response before the due date, it will be taken as if you have decided
not to respond to the information request and Council will continue with the assessment of
your application.
