Dear Mr Lewis,
Re: Application for a Development Permit
for Prescribed Tidal Works - U Drive Boat Hire
Lot 158 on SP146043 located at 256 Gympie Terrace, Noosaville.
I refer to our previous discussions in regard to the proposal to upgrade the jetty and
mooring facilities within the boundaries of the area leased by Bayeno Pty Ltd on the
Noosa River foreshore.
I act on behalf of Bayeno Pty Ltd which is the registered lessee for the subject
Marine Facility located at 256 Gympie Terrace Noosaville. On behalf of Bayeno Pty
Ltd I hereby apply for a Development Permit for Prescribed Tidal Works over the
subject area.
In support of this application, the following should be noted:
• The lessee is proposing to upgrade the jetty and mooring facilities located
within the lease area.
• The proposed works will achieve the rearrangement of vessel berthing
facilities within the existing commercial lease area.
• It is proposed that part of the jetty located on the river side of the existing jetty
will be replaced by a new modern jetty and mooring facilities.
• The new facilities have been designed to better cope with tidal variations and
sand accretions within the immediate area.
• No increase in the intensity of the existing use is proposed.

• The works will address maintenance issues associated with the age of the
existing jetty as well as improve the safety and efficiency of the mooring and
movement of vessels within the lease area.
• The works represent a substantial investment aimed at providing safer and
better facilities for tourists and local users.
• The works will produce a jetty that is in character with the other commercial
jetties on the foreshore.
• The visual amenity impacts will be minor and positive.
In further support of this application I have enclosed copies each of the following:
1. IDAS Forms 1 and 23
2. Evidence of Owner's Consent from the Queensland Government.

A. ASSESSMENT OF STATE DEVELOPMENT ASSESSMENT
PROVISIONS AND
B. ASSESSMENT OF THE IDAS CODE FOR PRESCRIBED TIDAL
WORKS IN THE COASTAL PROTECTION AND MANAGEMENT
REGULATION 2003, SCHEDULE 4A.
Re: Application for a Development Permit for Prescribed Tidal Works
Lot 158 on SP146043 located at 256 Gympie Terrace, Noosaville.
A. Assessment of State Development Assessment Provisions.
I have reviewed the State Development Assessment Provisions and have concluded
that the provisions are not relevant to this application.
B. Assessment of the IDAS Code for Prescribed Tidal Works in the Coastal
Protection and Management Regulation 2003, Schedule 4A.
In regard to compliance with the assessment criteria contained in the IDAS code for
Development Applications for Prescribed Tidal Works contained in schedule 4A to
the Coastal Protection and Management Regulation 2003 the following should be
noted:
1. The Prescribed Tidal Work is compatible with the character and amenity of its
surrounding area;
The proposed works represent a berthing rearrangement within the boundaries of a
commercial lease area on' the Noosa River foreshore. The works propose the
replacement of a section of an existing jetty with a new modern jetty structure. The
works will address maintenance issues as well as improve the safety and efficiency
of mooring and vessel movements within the lease area. The proposed jetty
refurbishment is located on the river side of the existing structure and is visually
consistent and in character with other commercial jetties on the foreshore. A
planning assessment dealing with these issues will be submitted to the Noosa
Council as part of this application.

Page 17
2. The Prescribed Tidal Work is designed and constructed in a way to ensure it
is structurally sound;
The plans for the works have been designed and certified by a Registered
Professional Engineer who specialises in Marina Design.
3. The Prescribed Tidal Work is safe for use;
The plans for the works have been designed and certified by a Registered
Professional Engineer who specialises in Marina Design.
4. The Prescribed Tidal Work is adequately serviced with infrastructure,
including, for example, infrastructure for supply of water or the discharge of
sewerage;
The proposed works relate to the replacement of a section of jetty with a new
section of jetty and mooring facilities. There is to be no change to the
infrastructure that currently services the existing facilities.
5. The Prescribed Tidal Work involves only minimal use of tidal water in a
canal, for a non-maritime purpose;
This criterion is not applicable to this application.
6. The Prescribed Tidal Work does not cause a significant adverse affect to any
of the following -
(i) existing public access to any foreshores or any tidal water;
(ii) navigable access to, or navigable egress from, any non-tidal work lot;
(iii) the natural features of any tidal water, including, for example, the water quality
and bed and banks of the tidal water;
(iv) the structural integrity, operation or maintenance of any existing structure.
The proposed works represent a berthing rearrangement within the boundaries of a
commercial lease area on the Noosa River foreshore. The works propose the
replacement of a section of an existing jetty with a new modern jetty structure. The
works will address maintenance issues as well as improve the safety and efficiency
of mooring and vessel movements within the lease area. The proposed jetty
refurbishment is located on the river side of the existing structure. The works will
have no effect on existing public access to the foreshore or the river as they are
located on the river side of the existing jetty and contained entirely within the existing
lease boundaries. Local navigation on the river will not be affected. There will be no
impact on the river bank and the only impact on the river bed will relate to the
placement of four piles. The works have been designed and certified by a registered
professional engineer.
If you require any further information or assistance please contact the writer.
Yours faithfully,
EY
