     CONDITIONS

     1.     All works are to be constructed in accordance with the approved drawings and specifications list d
            in the approved plans section of this permit.

     2.     All reasonable and practicable measures must be taken to avoid or minimise the risk of the release
            of contaminants to waters.

     3.     Measures must be taken to limit turbidity in tidal waters as a result of the works.

     4.     Disturbance to the bed and banks of the waterway must be kept to a minimum.

     5.     Any material or debris that falls or is deposited on tidal lands during the works must be removed
            at the applicant’s cost and expense prior to the practical completion of the works.

     6.     A report from a registered professional engineer must be submitted to EHP on request, certifying that-

                   (a)the works (including any other associated works) have been constructed in accordance
                   with the approved drawings; and

                   (b)the works are structurally adequate for anticipated usage; and
                   (c)the bed and banks of the waterway for a distance of 15m around the site of the works
                   are clear of all debris.

     7.     The chief executive administering the Coastal Protection and Management Act 1995 may order
            the works be removed or modified within a reasonable time, if the works have or are likely to
            have a significant effect on coastal management because the works:

                        (i)      create a navigation hazard or other danger to the public; or
                        (ii)     cause erosion or land   degradation; or
                        (iii)    are   unstable; or
                        (iv)     have not been constructed according to the approved plans.
