OBJECTION TO PLANNING APPLICATION
Application No: 51983.3225.14
Type: Material Change of Use 23 July 2021
Property ID: 501555
The Hastings 9-10/30 Hastings St Noosa Heads
Land Description: Lot 30 SP 307674
I object to the proposed development for the following reasons;
The property exists in a Community Title Scheme (CTS), designed by Gabriel Poole in the 1980’s, where there is a general
consistency of design and shape. Each block has a different shape and size and each “beachhouse” in the CTS is placed
differently respecting light, privacy and general amenity to each other creating an overall garden amenity. The proposed
house in this application is not consistent with the overall look and amenity of the CTS. The Hastings CTS is a well-
regarded holiday accommodation facility on Hastings St as it provides private beachhouses for primarily 4-6 people
rather than apartment accommodation. The complex is a community development and this proposal is at odds with the
overall nature of the complex.
Although designed in the 1980’s it has been shown over the past decade that the buildings can be upgraded to modern
holiday offerings with internal refurbishment rather than being rebuilt. Additionally, the “moral rights” of the architect
and his estate on the buildings and complex are not addressed in this application.
As the proposed development is in the centre of the complex on the western side, the proposed building significantly
impacts the amenity, privacy and light to several other beachhouses throughout the year.
Currently the CTS is a green corridor in the centre of Hastings St from the river. This proposal will reduce the green space
in the complex and reduce the green corridor.
The proposed building significantly changes the offering of residential holiday accommodation in the CTS, creating a
property that is more appropriate in the Witta Circle, Little Cove or Noosa Springs areas. There are currently 2 houses
accommodating up to 6-8 people each while the proposed building is estimated to accommodate on average up to 6-8
guests only.
The proposed building is imposing. It is taller than all the other buildings surrounding it and it is expected that the
proposed roof terrace with bar/kitchenette and hot tub will create a noise issue in the complex and neighbouring areas
due to echoing from the surrounding buildings including the Sebel to the east and BayView Shopping Complex to the
west as well as create regular breaches of the CTS by-laws regarding noise and balcony use at night.
The overall implied “footprint” of the new building including eaves and balconies is larger than the current footprint and
it blocks visual access to the general landscaping of the complex. This impacts on the overall footprint of the CTS and
other owners with regards to the overall coverage allowed under current Council regulations.
The owners making the proposal have had their plans rejected 3 times at AGM’s and EGM’s of The Hastings CTS and have
at no time made any attempt to amend their plans to address the concerns of the other owners. They also own 2
adjacent properties in the CTS being No 7 & 11, and will effectively be creating a personal compound within the complex.
The responses of compliance by the applicant in the Tourist Accommodation Zone Code & Noosa Head Local Plan Code
do not address the change in nature of the buildings within the CTS. As the CTS is different to the other complexes in
The Hastings Street area these requirements and responses do not consider the impact on the CTS overall. In all the
proposal is not consistent with the Noosa Plan 2020.
I therefore ask that you reject the application with regards to its impact on the CTS overall together with the size, style
and scale of the proposed building as it relates to the other buildings in the complex.
