L03 Response to Councils information request
Council’s Reference: MCU18/0006.03 Our Reference: 2860 L02 NG Our Contact: Nadine Gorton 23rd June 2021 Chief Executive Officer Noosa Council PO Box 141 TEWANTIN QLD 4565 Attention: Planning Assessment Dear Sir/Madam, RESPONSE TO INFORMATION REQUST DEVELOPMENT PERMIT FOR AN OTHER CHANGE TO DEVELOPMENT APPROVAL MCU18/0006 FOR SHORT TERM ACCOMMODATION OVER LOTS 0, 1 AND 2 ON SP314091 AND LOCATED AT UNITS 1 AND 2/10 HILL STREET SUNSHINE BEACH I refer to the above application and the information request issued by your Council and dated 22nd March 2021. This request listed 2 items that Council considers is necessary in order to complete its assessment of the above application. The applicant provides the following response: Item 1: Provide the number of beds proposed/expected number of people for the short term accommodation use. Applicant’s Response to Item 1: The applicants advise that Unit 1 and Unit 2 have facilities that can cater for up 8 people in each unit. Due to the size of the units, it is anticipated that they will cater for families or couples. Item 2: Provide the required number of spaces, while allowing access to existing parking and manoeuvring on site. Applicant’s Response to Item 2: The subject site was approved and constructed in accordance with the 2006 Noosa Plan for a Type 2 Duplex which required the provision of 3 car parking spaces on site. The development provided for 4 car parking spaces on site which was excess of the Planning Scheme requirements. The Noosa Plan 2020 details that short term accommodation is to provide the following car parking on site: Two spaces for each unit: One space per four dwellings. The site currently provides 4 car parking spaces on site in the form of a two single garages and two single carports. The area in front of the existing designated car parking spaces is able to be used for tandem carparking with the wide access driveway to Hill Street able to be used for manoeuvring if required. The photograph below illustrates the existing vehicular arrangements.

It is noted that Council has recently approved tandem parking and the use of uncovered parking spaces of
duplex developments for short-term accommodation applications in existing unit developments including:
MCU20/0097: 1/27 Hill Street ,Sunshine Beach - Short Term Accommodation – 2 spaces
MCU20/0119: 20 Nannygai Street, Noosaville – Short Term Accommodation (Unit 1) – 2 spaces plus
tandem
The above approvals and carparking availability on the subject site were discussed with Council staff who
agreed that the use of the driveway area for one tandem space would be acceptable, however they would
need to consider whether the access onto Hill Street was appropriate. It is noted that both the above approvals
do not provide for manoeuvring on site when additional vehicles are parked in tandem and that MCU20/0097
(Hill Street) reverses directly onto Hill Street.
The subject site has a wide driveway and manoeuvring area that extends across the front of the site as
demonstrated by the photograph above. This area provides good visibility and manoeuvring on and off the
site.
The planning scheme also details that motorcycle spaces can be provided on site in lieu of carparking spaces.
In this instance one additional space is required for the use of the site for short term accommodation which
equates to 4 motorcycle spaces. These spaces can easily be accommodated at the front of the site if required.
The proposed carparking layout is considered appropriate based on the small scale nature of the use with
sufficient carparking available on site.
Additional Item : Concern with regard to the overlooking from the rear of this site into adjoining
property, in particular from the second level balconies. Five properties are potentially affected by this
overlooking. Please provide how this is proposed to be managed and provide visual representation in your
response.
Applicant’s Response to Item: The subject site is located in an area that comprises a mixture of
permanent and holiday accommodation and it is noted that two of the sites to the rear of the premises
(9 and 11 Oak Street) are currently listed as being available for holiday accommodation
(Planetofhotels.com and Airbnb). The plan below details the location of various short term holiday rental
properties that could be sourced from on line sources.

To address Councils concerns of overlooking the applicant proposes to undertake the following works
on site:
Undertake supplementary screen planting along the rear of the premises. The applicant is willing to
consider a condition in this regard.
Install Zipscreen blinds to the upper rear balconies to reduce opportunities for overlooking. The
blinds will be secured in place when used for short term accommodation. The applicant is willing
to consider a condition in this regard.
The applicant notes that the duplex dwelling was approved by Council and has always detailed the provision
of the rear decks and balconies. The use does not seek to change the building form or function merely enable
it to be used for short term accommodation as well as permanent accommodation.
The applicant considers that they have now responded to Council’s information request and withdraws the
notice stopping the information request period. Could you please provide us with a list of adjoining owners so
that we can commence public notification of the application?
Please contact our Sunshine Coast office if you require any further information and/or clarification.
Yours faithfully,
Nadine Gorton
