3.5.      REASONS FOR REFERRAL AGENCY DECISION
The list below sets out a summary of reasons for the referral agency to consider. This is included in this
report in order to assist the relevant department in writing their Referral Agency Response, as set out in
section 55(2) of the Act. The reasons for referral are:

•   Unexploded ordinance (‘UXO’) is considered a contaminate under Section 11 of the Environmental
    Protection Act 1994;

•   The subject site is located on a parcel of land within the potential for UXO contamination;

•   The site has been developed and used to date;

•   The site has been referred previously to the Department of Environment and Resource Management and
    conditions have been imposed (ref: Project No. 381926) dated 03 February 2012.
