ORDINARY MEETING AGENDA 21 NOVEMBER 2019

PLANNING & ENVIRONMENT COMMITTEE RECOMMENDATIONS

12 NOVEMBER 2019 - Crs Brian Stockwell (Chair), Jess Glasgow, Ingrid Jackson and
Cr Tony Wellington
Apology: Nil
Other Councillors in attendance: Cr Frank Wilkie (Item 2-7) and Cr Frank Pardon.

1 COMMUNITY AND ENVIRONMENT GRANTS PROGRAM FUNDING - ENVIRONMENT
     PROJECT GRANTS (ROUND TWO)
Cr Stockwell declared a perceived conflict of interest in this matter (as defined in section 175D of the
Local Government Act 2009) in relation to the grant application by the Mary River Catchment
Coordination Association Inc (MRCCC). Cr Stockwell advised that as a Sole Trader in his business
Watershed Australia, he has both been contracted by, and have subcontracted officers of, MRCCA
during this term of Council. In addition, Cr Stockwell advised that he is Council’s nominated
representative for the MRCCC. Cr Stockwell left the meeting room for the debate and decision on this
     matter.
Cr Wellington declared a perceived conflict of interest in this matter (as defined in section 175D of the
Local Government Act 2009) in relation to the grant application by Ecosystem Management Biosecurity
Solutions (auspiced by the Peregian Beach Community Association (PBCA)). Cr Wellington advised
that local resident and President of the PBCA, Barry Cotterell, provided a $200 donation to his election
campaign on 17 March 2016. Cr Wellington advised that he is not, nor has ever been, a member of the
PBCA and as far as he is aware, neither the PBCA nor Mr Cotterell will benefit financially from the grant
under consideration. Cr Wellington believed that he could consider this item impartially and in the public
interest and requested to remain in the meeting room to participate in the debate and vote on this matter.
Pursuant to section 175E(4) of the Local Government Act 2009, the remaining Councillors gave
consideration to whether the conflict was a real conflict or perceived conflict and whether Cr Wellington
may participate in the meeting for the debate and vote on this matter or whether he must leave the
meeting for the debate and vote on this matter.
     Committee Recommendation
     Moved: Cr Glasgow
     Seconded: Cr Jackson
That Cr Jackson be appointed as Acting Chairperson of the meeting for consideration of this item.
                                                                                        Carried unanimously.
Cr Wellington voted in favour of the above motion.
     Committee Recommendation
     Moved: Cr Jackson
     Seconded: Cr Glasgow
That Councillors note the perceived conflict of interest declaration of Cr Wellington and resolve that this
represents a perceived conflict of interest in this matter and Cr Wellington may remain in the meeting
room to participate in the debate and vote on this matter.
                                                                                        Carried unanimously.
Cr Wellington did not vote on the above motion.
     Committee Recommendation
     Moved: Cr Wellington
     Seconded: Cr Glasgow
That Council note the report by the Environment Services Manager to the Planning &
Environment Committee Meeting dated 12 November 2019 and approve the 2019-20 Round
Two Community and Environment Project Grants provided in Attachment 1 to the report.
                                                                     Carried unanimously.
Cr Wellington voted in favour of the motion.
Cr Stockwell returned to the room and resumed the Chair.
