SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 11 APRIL 2017
Function centres, particularly those including outdoor areas, have historically been problematic
and a number have significantly impacted on nearby residents and led to appeals in the
Planning and Environment Court. Noise impacts from patron and entertainment noise at
wedding receptions have shown to be some of the most difficult impacts to manage , with the
only successful measure in mitigating noise found to be to prohibit the use of outdoor areas or
at the very least the limit the hours of the outdoor area.
Use of the park reserve for functions constitutes a material change of use under The Noosa
Plan and also requires a development approval.
The applicant’s request for event approvals for the remainder of 2017 is not supported because
that would be contrary to the requirements of The Noosa Plan and the Sustainable Planning
Act 2009 and is an unreasonable proposition for neighbouring residents whose amenity may
be adversely impacted by the unlawful use of reserve land.
A maximum period of 3 months is considered a reasonable compromise to allow the most
immediate events currently booked to be held and alternate arrangements to be made for other
events beyond that date, which may include hosting functions fully within the restaurant
building.
Accordingly, it is recommended event permits be issued to 21 July 2017 only, which would provide
the applicant with three months to make suitable alternate business arrangements for its function
bookings.
