GENERAL COMMITTEE MEETING AGENDA 17 SEPTEMBER 2018
REPORT
On 1 July 2011, the State government commenced the Adopted Infrastructure Charges regime
which replaced all other forms of infrastructure contributions and charges applying to new
development approvals from that date. This required local governments to adopt Infrastructure
Charges Resolutions that complied with the Sustainable Planning Act 2009 (SPA) and State
Planning Regulatory Provision (adopted charges) (SPRP) current at that time.
Various reviews, amendments and updates of the legislation have continually occurred over the
past seven years which have sometimes required consequential amendments and updates to be
made to local government infrastructure charging resolutions.
The legislative periods impacting infrastructure charges are highlighted below:
Prior to 1 July 2011 (IPA 1997 & SPA 2009)
o Planning Scheme Policy (PSP) contributions as conditions of a development permit &
infrastructure charges under CMRNICP
1 July 2011 to 3 July 2014 (SPA 2009 & SPRP)
o Adopted infrastructure charges
o Discount for existing development at Council discretion
o No specific indexation requirements other than simply limited to maximum SPRP
amount
4 July 2014 to 2 July 2017 (SPA 2009 & SPRP)
o “levied charge” terminology introduced
o Limitations of levied charge (only for extra demand)
o Additional indexation limitations
From 3 July 2017 (Planning Act 2016 & Planning Regulation 2017)
o Limitations of levied charge (only for extra demand)
o Indexation limitations
o Transitional clause 302 complications
