PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 25 MARCH 2014

Precincts 1 and 2 are proposed on this land, with the uses in these precincts being detached and
attached housing, aged care and commercial uses. With the exception of a single detached
dwelling, none of the proposed uses are identified as preferred or acceptable uses.

The proposed urban development fundamentally conflicts with the planning scheme’s land use
intent, which stresses the importance of the area’s environmental and open space values.
Allowance of urban development in an area corresponds with levels of construction and ongoing
impacts that must also be accepted (regardless of best practice development and management
methods employed). As such, the Maroochy Plan 2000 stance in avoiding urban development in
this location reflects the site’s environmental constraints and the significance of its natural
resource and landscape values.

Land Use and Works Provisions

The following Maroochy Plan 2000 overlays apply to this application:

 Waterways, Wetlands and Fish Habitat areas
 Flood Prone Land
 Nature Conservation and Biodiversity Management
 Acid Sulfate Soils
 Bushfire Prone Areas
 Heritage Conservation

The following land use and development codes which regulate land use and design apply to this
application:
 Code for Nature Conservation and Biodiversity
 Code for Waterways and Wetlands
 Code for Assessment and Management of Acid Sulphate Soils
 Code for Development in Water Resource Catchment Areas
 Code for Development in Bushfire Prone Areas
 Code for Transport, Traffic and Parking
 Code for Landscape Design
 Operational Works Code
 Heritage Conservation Code
 Code for Integrated Water Management
 Code for Erosion and Sediment Control

The primary issues arising from the assessment against both local government planning
schemes are detailed in Section 6.5 of this report.
The Noosa Plan
Locality Provisions

Precincts 3 and 4 of the development site are located in the Tewantin and Doonan Locality under
The Noosa Plan and zoned Rural Settlement and Rural. The proposed uses within these
precincts comprise detached and attached housing, aged care and rural residential land uses.
None of the proposed uses are identified as consistent with the zoning of the land on which
they’re proposed (with the rural residential use proposed on Rural zoned land).
