PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 25 MARCH 2014

     17. The applicant has not demonstrated sufficient grounds exist to overcome the
development’s conflicts with relevant assessment instruments.
B. Refuse that part of the application that falls within the Sunshine Coast Council local
government area, as directed by the Sunshine Coast Council in its concurrence agency
     response dated 5 February 2014.

REPORT

1 PROPOSAL
The application seeks preliminary approval under Section 242 of the Sustainable Planning Act to
vary the effect of The Noosa Plan and Maroochy Plan 2000 for a mixed-use community title
development. The development is to be known as Noosa on Weyba and comprises a mix of
residential, community, commercial and open space uses to be established under a multi-level
community title structure.

The site sits outside the urban footprint areas identified in the South East Queensland Regional
Plan, which normally prohibits urban development, but this application has been made possible
by the State’s gazettal of a Biodiversity Development Offset Area (BDOA) over the site. The
BDOA agreement requires the transfer of three of the site’s component allotments (139.5Ha) to
public ownership as national park if the application is approved.

The applicant proposes a Noosa on Weyba Locality Plan to generally override the local planning
schemes’ provisions for the site by applying differing codes and levels of assessment to future
development. The Plan identifies four primary urban precincts with varying densities and
character. The proposed precinct plan is shown below and included at A3 size as Attachment 1.
