2. STATUTORY PROCESS
The proposed change to the development approval requested by the applicant is determined to
constitute a permissible change in accordance with S367 of the Sustainable Planning Act 2009
on the grounds that:
The change would not result in a substantially different development. Whilst the proposed
amendments removes a number of the development’s resort components, reduces overall
gross floor area by 4,379m2 (-20%) and increases population density by 65 persons
(+18.2%) the nature and overall scale of the development is not considered to be
substantially different. Further assessment of the changes is included in Section 3.1 of this
report.
The changes do not trigger a new referral to the State Assessment and Referral Agency.
The original development application was impact assessable and did not attract any public
submissions. The changes do not introduce significant new aspects (such as increases in
height or scale, changes in development footprint or different uses) likely to cause persons
to make submissions on reasonable grounds ; and
The changes do not involve prohibited development.
The application was referred to the Department of Infrastructure, Local Government & Planning
to seek its views in relation to the State concurrence agency requirements applying to the
existing approval. The Department responded on 19 January 2016 advising it has no objection to
the changes.
The application was also referred to Unitywater because the approval includes water and sewer
conditions. Unitywater advised on 20 January 2016 it had no objection to the changes and the
existing water and sewer conditions can be maintained.
