PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 1 MARCH 2016

REPORT
A report on a Development Application for Material Change of Use for Operational Works for
Placing Advertising Devices (Signage) at 78-80 Rene Street, Noosaville was considered by
Council at its Ordinary Meeting on 14 January 2016. Council resolved to refuse the application
citing three reasons.

An appeal was lodged with the Planning and Environment Court on 1 February 2015 by the
applicant. The appeal seeks to overturn Council’s decision to refuse the application.

It is in order for Council to defend the appeal and the recommendation is worded accordingly.

Previous Council Consideration

Ordinary Meeting 14 January 2016, Item 7, Page 5
That Council note the report by the Manager, Planning & Environment to the General Committee
Meeting dated 11 January 2016 regarding Application No. OPW15/0214 for a Development
Permit for Operational Works - Signage situated at 78-80 Rene Street, Noosaville and refuse the
application for the following reasons:
1. The application proposes signs in excess of 4m2 sign face area and total signage area on
the premise in excess of 10m2, which are inconsistent with the Overall Outcomes of The
         Noosa Plan’s Advertising Devices Code;
2. The proposal represents excessive signage for a single business that will result in
unnecessary visual clutter and dominate the streetscape.
3. The signage is incompatible with the existing and preferred streetscape character and is
contrary to the Advertising Devices Code.

Finance & Risk
There will be significant costs for Council involved in defending the appeal and it is premature to
advise on the appeal prospects at this stage.
