2. Proposal
The proposal involves constructed a dam at the premises. The dam is to be positioned in the rear (northern)
portion of the property where the ground surface levels range from approximately RL111m to 112m and it is
anticipated that the cut and fill earthworks will be in the order of 1-2m deep/high. The dam will occupy an
area of approximately 390m2 (measured along the centre line of the dam wall) and will have depth of 2.5m
relative to the surface water level. The downslope embankment batter will extend for a distance of
approximately 5m at a gradient no steeper than of 1V:3H. The upstream face will have a slope of 1V:2.5H. A
3.5m wide crest will also be adopted.

Site Details The subject site is located at 8 Robin Place, Lake Macdonald described as Lot 13 on SP 315578. The site has a total area of 1.5303ha and is located within a recently completed rural residential estate. The lot is irregular in shape, being narrow at the site’s frontage and widening in the rear (northern) portion of the site. The site contains dense vegetation in the northern portion of the site which is protected by a vegetation covenant. The site contains a small level house pad adjacent to the frontage of the site which is contained within an irregular shaped building envelope. The site generally slopes down to the northwest at an average gradient of 8.6%. Figure 1 - Aerial Photograph if site and surrounds

4. Assessment
4.1 Framework for Assessment
Categorising Instruments for Statutory Assessment
In accordance with Section 43 of the Planning Act 2016, the following categorising instruments may contain
assessment benchmarks applicable to development applications:
• the Planning Regulation 2017
• the Planning Scheme for the local government area
• any temporary local planning instrument
• any variation approval
Of these, the planning instruments relevant to this application are discussed below:
4.2 The Noosa Plan
Level of Assessment and Assessment Benchmarks
Pursuant to Table 5.8.3 of the Noosa Plan 2020, Operational Work - Excavation or Filling for the purpose of
a dam is accepted development subject to the following requirements if:-
a) involving 500m³ or less of material;
b) for the purpose of constructing a dam; and
c) not associated with a material change of use.
The proposed dam will exceed 500m3 of excavation and consequently be code assessable against the
following codes:
• Earthworks Code
• Water Quality and Drainage Code
Overall, the proposed development achieves the purpose of the abovementioned codes in that:
• the dam will be designed and constructed so as to appropriately manage stormwater, groundwater
and environmental flows so as to protect downstream environmental values and water quality; and
• the earthworks will not unreasonably impact on the natural environment or other properties and
result in a safe environment.
Please refer to the accompanying reports, including the Geotechnical Investigation Report and the Ecological
Assessment Report further details.
