Dear Sir/Madam

Information Request
Sustainable Planning Act 2009

I refer to your application and advise that Council requires further information to satisfactorily assess the proposal.

application details
Application No:	OPW15/0099
Proposal:	Development Permit for Operational Work - Bulk Earthworks
Street Address:	19 Trading Post Rd COOROY QLD 4563
Real Property Description:	Lot 1 RP 215922
information required
The information requested is set out below:

Issue
Condition 72 of the higher order approval requires a Stormwater Management Construction and Maintenance Plan (SMCMP) to be approved by the Council’s CEO or delegated officer prior to issue of any Operational Works Approval. This must be provided prior to issue of an Operational Works Approval.

Information Required
Please provide the Stormwater Management Construction and Maintenance Plan (SMCMP) required by Condition 72 of the higher order approval.

Issue
Condition 90 of the higher order approval requires plans detailing the methods of controlling erosion and sediment to be submitted to the Council for approval prior to obtaining a Development Permit for Operational Works. The provided Erosion and Sediment Control Plans are not reflective of the Approved Staging Plan, do not indicate how Specific Outcomes O1 and O2 of the Noosa Plan Erosion and Sediment Control Code will be achieved with the proposed cut to fill strategy and do not provide sufficient information to demonstrate how compliance with the State Planning Policy for Water Quality is possible.

Information Required
Please provide detailed sediment and erosion control plans that demonstrate that the proposed development will comply with the State Planning Policy for Water Quality. In particular, the plans must detail:
Proposed staging to minimize the area of exposed soil at any one time. Where it is necessary to keep areas exposed beyond each stage shown on the Approved Staging Plan CO-000-2014 Sheet 02 of 02 dated 02/02/15 to win or place fill, comment including calculations must be provided to justify the additional footprint of exposure at one time.
The dimensions of temporary drainage control structures necessary to facilitate diversion of clean stormwater around or through the site without increasing the concentration of total suspended solids (TSS) or other contaminants in the flow and without causing erosion (onsite or offsite). The sizes of the drains are to comply with the sizing requirements in Appendix 3, Table A of the State Planning Policy.
Lining requirements to prevent scour and entrainment of sediments within temporary clean water diversion drainage control structures as specified in Table 5.2 of the Sunshine Coast Regional Council Manual for Erosion and Sediment Control Version 1.2 (or equivalent reference of the International Erosion Control Association Best Practice Erosion and Sediment Control 2008 Books)
A comment from a RPEQ to confirm that temporary drainage designs will comply with Condition 68 of the higher order approval.
Calculations to identify the sediment basin volumes necessary within each exposed sub-catchment to capture and treat the design storm event required by in Appendix 3, Table A of the State Planning Policy.

Issue
Please note that the application indicated that no flora or fauna inspections will be required during construction. The Nature Conservation Act is administered by the Queensland State Government separately to the State Planning Act processes. This Act has requirements as they relate to tampering with breeding places for native animals and also for clearing within areas mapped as high risk. Noosa Council suggests that you undertake necessary investigations to confirm you comply with these requirements.

Please be aware that under Section 279 of the Sustainable Planning Act 2009, the applicant must respond to the Information Request within 3 / 6 months of the request or otherwise, the application lapses.

A response to the above is required to be submitted, prior to further assessment of the application. If any further matters arise as part of assessment of this application, you will be advised accordingly.
