Risks & Opportunities
Legal advice is that Council should adopt the resolutions contained in this report to reflect the
change in head of power from State Legislation to Local Law No.7 (Waste Management) 2018.
These resolutions clarify various waste management service undertakings previously agreed to
by Council and will support the Annual Revenue Statement in relation to charging for various
waste collection services.
Failure to update the reference to the new local law will expose Council to risks of being
challenged by stakeholders, occupiers and owners about the validity of council’s authority to
implement the provisions of the new local law and enforce mandatory participation in the waste
collection services, acceptable service frequency and use of approved waste storage containers
including associated charges for those collection services.
