PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 DECEMBER 2017

Any repair work which proposes to alter the alignment or level of existing services
and assets must first be referred to the relevant service authority for approval.
B. Find the following grounds sufficient to support the proposal:
     1. The land enjoys existing use rights for various uses including some industrial uses
with the potential to generate off site impacts. The proposed development seeks
approval for a reduced range of uses able to operate from the site which are
considered more compatible in the area; and
     2. The development offers various improvements to the site and provides an improved
interface between adjoining residential uses. The proposed building renovations and
landscaping outcomes collectively improve the visual amenity of the site and are
           considered an overall community benefit.

REPORT
1. PROPOSAL
The application seeks approval for a Material Change of Use for a Retail Business Type 6 –
Hardware and Retail Business Type 7 – Garden & Lifestyle Centre.
The applicant suggests that the proposed uses generally reflect the existing use rights on the
land, which also includes the pool shop use that has existed on the land for a number of years
without approval.
Existing use rights over the site relate to an approval issued by Council on 23 May 1977 for
“Renovations to an existing building to permit hardware store/tyre & wheel alignment service,
office, storage and cabinet maker”. The applicant suggests the Hardware component is
consistent with existing use rights while the proposed Garden & Lifestyle Centre reflects the
current unlawful pool shop business which in the past has sold pools, spas, outdoor furniture,
garden ornaments and the like, akin to the Planning Scheme definition of a Garden Centre use.
Built Environment
The applicant intends to renovate the existing 454m2 building which includes aesthetic upgrades
to improve the overall building appearance and presentation. The aesthetic improvements
include a new render to the existing block wall, a combination of lightweight and metal cladding to
the building elevations, a new awning to Eumundi Road frontage, new windows, sliding doors
and re-sheeting of the existing roof. The building will be finished with subdued colours and muted
tones. Proposal plans are provided in Attachment 1.
The application also proposes to retain an existing 74m2 storage shed located in the north-
eastern corner of the site and intends to demolish (at a later date) an existing building
encroaching over the common boundary of 105 and 101 Eumundi Noosa Road. Both lots are in
the same ownership however the 101 Eumundi Noosa Road is only subject to this application.
Approval is also sought for a separate 462m2 outdoor display area which the applicant suggests
has been historically used for the sale of pools, spas, garden ornaments and the like, in
association with the current pool shop. The applicant has not indicated what this area is intended
to be used for.
Revitalised soft landscaped areas are proposed which include a 3.0m soft landscaped setback to
a portion of the site’s frontage to Eumundi Noosa Road, a 2.0m landscape strip along a majority
of the rear boundary and some internal landscaped areas.
A stormwater detention basin is proposed in the south-eastern corner of the site intended to
collect stormwater runoff from the impervious areas.
