PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 DECEMBER 2017
5. CONCLUSION
The application seeks approval for a Material Change of Use of Premises to permit Retail
Business Type 6 (Hardware) and Retail Business Type 7 (Garden & Lifestyle Centre).
The subject site is located in the Noosaville Locality and is zoned Attached Housing. The
proposed uses are identified as inconsistent uses within the zone and are required to follow an
impact assessable application process.
The land enjoys existing use rights for various uses including hardware store, tyre & wheel
alignment service, cabinet maker, office and storage. The proposed Hardware use raises no
major concern as the use is not likely to generate greater impacts beyond what’s expected under
current use rights which permits the same use to operate without further approval.
Retrospect approval is also sought for a proposed Garden & Lifestyle Centre which the applicant
suggests is best suited to the pool shop use and associated outdoor display which has operated
from the site prior to 1993. It is noted such a use may include an ancillary coffee shop which
raises some concern with regards to offsite impacts. Conditions of approval have therefore been
included limiting the extent of the floor area.
Although approval is sought for uses inconsistent with the zoning of the land, the range of
incompatible uses lawfully able to operate from the site is being reduced, some of which include
industrial business such as a mechanical workshop and cabinet maker which have the potential
to generate greater offsite impacts.
The application offers various improvements to the site including renovations to the existing
building, revitalised landscaped areas and formalisation of driveway and car parking areas which
collectively improve the visual amenity of the site which are considered an overall community
benefit.
