Dear
Information Request
Planning Act 2016
I refer to your application and advise that Council requires further information to satisfactorily assess the proposal.
application details
Application No.	MCU21/0193
Street Address:	Noosa Cine Centre 29 Sunshine Beach Rd Noosa Heads Qld 4567
Real Property Description:	Lot 15 SP 111607
Planning Scheme:	Noosa Plan 2020 (25 September 2020)
INFORMATION REQUIRED
The information requested is set out below:
Issue
The proposed use has provided the hours of operation in accordance with PO9 of the Recreation Activities Code.
The proposed use is to occur within an existing commercial building that contains a shared wall with adjoining tenants. It is envisaged that the operation of the fitness activity will result in the emission of noise. It is unclear as to what equipment and noise mitigation devices are to be utilised.
To ensure that the use will not have any negative impacts on the amenity of the surrounding area and sensitive land uses, the applicant will need to provide an acoustic report containing the noise mitigation and noise management protocols.

Information Required
An acoustic report prepared by a qualified acoustic engineer assessing the compliance of the use and outlining specific noise attenuation measures to ensure that the surrounding area is not impacted by the proposal and to ensure that the proposed activities does not impact sensitive receptor areas including tenants occupying neighbouring spaces.
Activities in gyms, particularly the dropping of weights, can generate high levels of vibration and structure borne noise in the underlying building structure. Vibration isolation is therefore necessary to reduce the transfer to adjacent sensitive areas such as residences, particularly when gyms are located over sensitive areas. Any noise and vibration transmitted by the gym within the proposed development is required to comply with the noise and vibration limits in accordance with the relevant standards. The development of an effective noise management strategy should accompany the proposal with details of all insulation treatment and mitigation measures.
Council may consider noise emissions as below:
7am to 10pm - no more than five decibels (A) above the background noise level
10pm to midnight – no more than three decibels (A) above the background noise level
Midnight to 7am – no noise heard
Issue
