EXECUTIVE SUMMARY
The applicant seeks approval to change to an existing development approval to reconfigure the
maintenance shed to include additional covered car parking spaces and a 1-bedroom Manager’s
Unit. The proposed maintenance shed and associated carparking raises no additional issues
under the planning scheme.
The incorporation of a Manager’s Unit is possible as the applicant has re-calculated Gross Floor
Area (GFA) of the entire development based on the Noosa Plan 2020 definition, which excludes
components that were previously included in the Noosa Plan 2006 GFA definition. This results in
Page 4 of 57
Section 5
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
an additional 69.7m2 of GFA which complies with the maximum GFA for the site permitted under
the Noosa Plan 2020.
No further planning or engineering issues arise from the proposal to include a manager’s unit.
Overall, the resultant changes accord with the planning scheme requirements and otherwise
constitute a minor change to the development and therefore the application is recommended for
approval.
The application is before Council as the original development approval was issued by Council.
RECOMMENDATION
That Council note the report by the Coordinator Planning to the Planning & Environment
Committee Meeting dated 8 March 2022 regarding MCU15/0109.04 to make a minor change to a
development approval for Multiple Housing type 4 - Conventional (39 Units) situated at Resort
Drive Noosa Heads and:
A. Approve the change.
B. Amend the description of the development in the Decision Notice to read Material Change
of Use – Multiple Housing Type 4 – Conventional (39 Units & 1 manager’s unit).
C. Amend conditions 2, 3 and 31 to read as follows:
2. Development undertaken in accordance with this approval must generally comply
with the approved plans of development. The approved plans are listed in the
following table and may be further amended by the conditions of this approval.

pressure hoses /compressors to wash vehicles is not permitted.
E. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
REPORT
1. PROPOSAL
The applicant seeks approval to change to an existing development approval and reconfigure an
approved maintenance shed to include:
• An additional 1-bedroom unit (Manager’s Unit – 69.7m² GFA).
• Additional parking garage spaces / maintenance vehicular parking (previously 4 parking
spaces to 8 parking spaces), a car wash bay plus a carport space for the Manager’s Unit.

Figure 4 – Proposed Site Plan
2. BACKGROUND
The site forms Precinct E2 of the Noosa Springs residential community. Master planning for the
Noosa Springs locality was undertaken in the 1990’s, with the majority of the area now developed
for residential and golf course purposes, with associated recreational and community facilities.
The subject site and adjoining land to the north (Precinct F) form the eastern extremity of the
Noosa Springs locality and were historically used for sand quarrying purposes.
Section 10
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
Precinct E2 development approval history includes:
• MCU15/0109 - 16 September 2016 – Decision Notice – 44 units (4 x 1 bedroom, 22 x 2
bedroom and 18 x 3+ bedroom units) subject to amendment to unit density as part of the
original condition 4;
• MCU15/0109 - 20 December 2017 - Negotiated Decision Notice – 37 units (4 x 2 bedrooms
and 33 x 3-bedroom units);
• MCU15/0109.01 - 21 February 2018 – Minor Change Decision Notice – 29 units (1 x 2
bedrooms and 28 x 3-bedroom units), which deleted block 26;
• MCU15/0109.02 - 16 July 2018 – Minor Change Decision Notice – minor amendments to
landscaping and fencing.
The applicant advises
There is a separate development approval over the adjacent Precinct F for a Multiple
Dwelling comprising 140 Dwelling Units and Associated Facilities (Shop, Restaurant,
Multi‐Function Room and Gym). This approval has been the subject of a number of
amendments, with the most recent modification to the approval granted by Council on 22
November 2021 (refer 132005.1133.15). Conditions of this approval include a sunset date
of 15 December 2026, at which time the uncompleted aspect of the approval lapse if the
whole of the approval has not happened.
Precincts E2 and F has been developed in an integrated matter to allow for internal road
and pathway connections between the two sites. We note that the recent reconfiguration of
a lot (to facilitate the creation of up to 26 balance lots) approval issued by Council further
reinforces the staged and integrated manner within which these development approvals are
being delivered.
3. ASSESSMENT
3.1 Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of
the Planning Act 2016. An application for a minor change to a development approval can only be
made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
• the development would not result in substantially different development as the development
remains generally consistent with the original approval;
• the change does not include prohibited development;
• the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new matters prescribed by regulation;
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.2 Statutory Instruments – Planning Scheme
To facilitate the proposed changes the applicant seeks changes to the approved list of plans of
development being condition 2 and condition 3 as follows:
Condition 2 – Approved Plans
2. Development undertaken in accordance with this approval must generally comply with the
approved plans of development. The approved plans are listed in the following table and
may be further amended by the conditions of this approval.

Applicant’s Request
Update table to include the amended architectural drawings.
Assessment of Request
The submitted plans provide for an increase in the number of dwelling units from 39 to 40 in the
form of a 1-bedroom manager’s unit (69.7m² GFA) being accommodated adjacent to the
manager’s shed/facilities. The proposal plans also introduce additional carparking, garage
spaces / maintenance vehicle parking. Currently there are 4 spaces, and the applicant now
proposes 8 spaces, a car wash bay plus a carport for the Manager’s Unit. The changes result in
compliance with the Noosa Plan development parameters as follows:
• Site Cover remains at 29% significantly less than the allowable 40%.
• The Change results in a population density of 115.1 persons, however, does not exceed
the maximum allowable population density of 117.99 persons permitted under the
superseded planning scheme. Population density provisions are not included within the
Noosa Plan 2020.
• The proposed height of the buildings is 4 metres which complies with the maximum
allowable height of 12 and 8 metres permitted under both the current and previous planning
schemes respectively.
• The permitted Plot ratio of 0.4:1 allows for a maximum Gross Floor Area (GFA) for the site
of 4719.6m2. The proposed GFA is 4710.3m2 based on the Noosa Plan 2020 definition of
GFA which excludes components that were previously included in the Noosa Plan 2006
GFA definition.
A comparison of the current GFA definition and the Noosa Plan 2006 GFA definition is provided
in figure 5 below. The most notable differences include the following areas which are no longer
counted as GFA; floor area beyond 3 metres from an external wall, ground floor of stairwells,
building services, plan or equipment areas, and a ground floor public lobby.
Section 13
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
Figure 5 – GFA definitions
The following table (figure 6) provides a comparison of the approved plans against both
definitions of GFA. Each block (10 to 25) has a modest reduction in GFA which provides the
opportunity to include additional GFA in the form of the Manager’s Unit.
Figure 6 – GFA comparison totals
Therefore, the proposed changes are considered to comply with development parameters of the
Noosa Plan 2020. Whilst the proposal does not comply with the plot ratio permitted under the
superseded planning scheme if a new application were made for the whole development today it
would comply with the requirements of the Noosa Plan 2020.
The proposed amendment to Condition 2 will reflect the new set of plans and is therefore
supported.
Condition 3
3. The approved development comprises a total of 17 x 2 bedrooms and 22 x 3 bedroom
units.
Applicant’s Request
It is requested that this condition be updated to include the proposed new manager’s unit, and be
amended to read:-
3. The approved development comprises a total of 1 x 1 bedroom, 17 x 2 bedrooms and 22 x
3 bedroom units.
Section 14
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
Assessment of Request
The proposed amendment to Condition 3 will reflect the new set of plans and is therefore
supported.
Additional Considerations
Whilst not requested by the applicant, condition 31 (car parking) will require updating to include
reference to the additional 1 car parking space to be allocated to the Manager’s Unit.
The applicant has advised that use of the carwash bay will be managed by the on-site manager,
and it is anticipated that up to 3 cars per day will be washed. An additional condition, based on
advice of how the car wash will operate, is recommended to protect the amenity of nearby
residents from potential noise impacts of the car wash. The condition ensures only resident’s
vehicles are washed at the car wash and that no compressors or pressure hoses and the like are
to be used. The applicant has provided a review of the stormwater quality and quantity
implications of the proposed development, by Morgan Consulting Engineers, which demonstrates
that no change is required to the existing stormwater drainage system. The report notes that the
car wash bay is to be bunded, it is recommended that a condition be included to ensure that this
occurs.
Furthermore, a new infrastructure charges notice will be required to account for the additional
unit proposed.
4. CONSULTATION
4.1 Referral Agencies
4.2 Other Referrals
The application was forwarded to the following internal Council specialists:
• Coordinator Engineering
• Environmental Health
5. CONCLUSION & REASONS FOR DECISION
The application seeks a Minor Change to a Development Permit for a Material Change of Use –
Multiple Housing Type 4 – Conventional (39 Units) at 105 Resort Drive Noosa Heads. The
changes seek to increase the maintenance shed area/s and the number of dwelling units from 39
to 40 by including a manager’s unit. The resultant changes accord with the planning scheme
requirements and otherwise constitute a minor change to the development and do not result in
substantially different development as it is generally consistent with the original approval. The
application to amend the plans and consequential conditions is recommended for approval.

EXECUTIVE SUMMARY
The applicant seeks approval to change to an existing development approval to change the
permitted opening hours of the service station from 5am to 4am and permit illumination of the BP
Helios signs on the awning facia sign. Both requests, for earlier trading and additional
illumination signage raise concerns regarding additional impacts on amenity and are not
supported by the relevant provisions of the Noosa Plan 2020 and the Local Laws. Therefore, the
application is recommended for refusal.
RECOMMENDATION
That Council note the report by the Coordinator Planning to the Planning & Environment
Committee Meeting dated 8 March 2022 regarding MCU19/0089.02 and OPW19/0160.02 to
make a minor change to an existing approval for Material Change of Use - Retail Business - Type

situated at 52-54 Mary St Noosaville and:
A. Refuse the change for the following reasons:
Section 26
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
1. The proposed change does not constitute a minor change to the development
approval as the change in hours will increase the severity of known amenity impacts
and likely attract further submissions objecting to the change were the application to
be publicly notified given the site’s proximity to residential properties.
2. The proposed trading hours do not comply with Overall Outcomes 2 (d) & (h) and
Performance Outcome PO11 & PO24 of the Business Activities Code as the
proposed hours will adversely impact on nearby resident’s amenity.
3. The proposed trading hours do not comply with Overall Outcome 2(m) and
Performance Outcome PO42 of the District Centre Zone Code as the proposed
change in hours will impact the amenity of nearby residential premises as nearby
residents would not reasonably expect the service to be operational at this time.
4. The proposed illuminated signage does not comply with Specific Outcome AO7 and
Overall Outcome O7 of the Advertising Devices Code within the Noosa Plan 2006 as
it proposes more than one illuminated sign and is not compatible with the visual
amenity of the surrounding area.
5. The proposed additional illuminated signage is not consistent with provisions of the
Local Law signage requirements as the proposal exceeds the maximum number of
signs permitted to be illuminated and is prohibited by the Local Law.
B. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
REPORT
1. PROPOSAL
The applicant seeks approval to change an existing development approval to:
• change the permitted operating hours from a 5am opening to 4am opening; and
• include illumination of the small BP Helios signs on the awning facia sign.
2. BACKGROUND
A development approval for a Development Permit for Material Change of Use - Retail Business -
Type 2 Shop & Salon, Retail Business - Type 5 Vehicle Uses and Operational Works – Signage
was issued on 19 December 2019. The subject site is detailed in Figure 1 below:
Figure 1: Locality Plan
Section 27
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
3. ASSESSMENT
3.1 Instruments for Statutory Assessment
3.2 Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of
the Planning Act 2016. An application for a minor change to a development approval can only be
made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
not constitute a minor change on the grounds that it would result in a substantially different
development as it increases the severity of known impacts to residential properties within
proximity of the site and these residents would likely object to the change were they provided the
opportunity.
3.3 Statutory Instruments – Planning Scheme
The subject site is located in the Noosaville Locality and falls within the District Centre Zone. The
original development application was assessable against the whole planning scheme as an
impact assessable use. The applicant’s request for a minor change is assessed against the
relevant provisions of the planning scheme as follows:
Condition 5
5. The approved use must not operate outside the hours of 5am to 10pm.
Applicant’s Request
The applicant requests that the commencement time be changed to 4am. The applicant states
that there is significant demand for fuel, bait and other supplies associated with locals on their
way to go boating and fishing at this time. The applicant provided an addendum to the acoustic
report submitted with the original application to support their requested change which includes:
“the noise control recommendations of the approved noise report, including acoustic
barriers, would not have changed if trading from 4am were to have been originally
proposed”
The applicant advises no changes to condition 7 limiting the hours of service vehicle movements
is required and has provided the following additional statements:
“In summary—
1. Between 5:00 am and 6:00 am—the service station has an average of 20 transactions
each day;
2. Between 11:00 am and 12 Noon, then again between 3:00 pm and 4:00 pm, are the
busiest periods, averaging 70 transactions per hour.
We therefore ask that Council have regard to the following matters—
1. It would be reasonable to assume that the hour from 4:00 am to 5:00 am would be no
busier than the 20 transactions in the 5 til 6 am period.
2. 20 transactions in the first hour is sufficiently meaningful to the trading of BP
Noosaville—together with the operator’s experience with people arriving at the service
station and seeking service before opening hours, it also illustrates that there is a
community need that the extended trading would satisfy.
3. The site is located such that traffic generated by the use is most likely already travelling
on Mary Street or Weyba Road. It is not a use on a site that would attract non-residential
traffic into a residential street.
4. Assuming that 20 transactions equates to 20 trips, such traffic levels are unlikely to be
noticeable or distinguishable from traffic already on the road network.
Section 28
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
5. The service station incorporates noise barriers 1.8 metres and 3.0 metres high along
both side boundaries. The effect of these is that activity on the site is not visually or
acoustically noticeable. The report by the acoustic consultant confirms the effectiveness
of the barriers in achieving the relevant acoustic quality objectives.
6. We are not aware of any noise complaints associated with the operation of the use.”
Assessment of Request
The noise report to support the development operations was prepared and submitted with the
original application and is based on projected modelling and recommended mitigation measures.
At the time of the original application, being decided Council allowed the operator to continue
operating from 5am as this was consistent with the operations of the existing service station at
the time.
The submitted advice prepared by MWA is based on the projected forecasting and modelling
which formed part of the original acoustic report. No acoustic readings have been submitted to
demonstrate the actual extent of any existing operations and thereby quantified any potential
additional impacts on adjoining neighbours.
Taking this into account, it is considered that extending the operating hours and allowing for
additional noise sources (i.e. customers) to site at 4am, which is historically a quieter period of
the morning, has potential to increase the duration of impacts on adjoining residence and
therefore the proposal does not comply with PO11 of the Business Activities Code (detailed
below). It is reasonable to assume that the proposed change in hours of the service station would
attract some additional traffic to the area that might otherwise travel a different route to boating
ramps etc. or currently seek fuel elsewhere.
This code requires business activities to either avoid or minimise early morning noise nuisances
to sensitive land uses. By allowing an earlier trade period in the morning, the application seeks to
increase the duration of possible noise nuisances and therefore is considered contrary to the
aim/s of the PO, as it is not minimising or avoiding potential noise nuisances.
Furthermore, PO24 of the Business Activities code (detailed below) requires Service Stations to
maintain and protect the amenity of neighbouring residential areas.
By increasing the operating hours to 4am, the service station is not maintaining the quieter period
of the early morning which the surrounding neighbours have historically benefited.
It is noted that corresponding acceptable outcomes for both PO24 and P011 allow for business
operations to commence at 7am. The service station is already operating outside the planning
Page 28 of 57
Section 29
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
schemes accepted timeframe with a 5am start despite being within largely a residential
neighbourhood. The extension of operating hours to 4am has the potential to have additional
impacts (in terms of the duration of noise impacts) on adjoining sensitive land uses, therefore it is
considered that the proposal does not comply with PO11 or PO24 of the Business Activities
Code and the request to extend operating hours to 4am is unable to be supported.
Condition 103
103. Advertising devices undertaken in accordance with this approval must generally comply
with the approved plans of development. The approved plans are listed in the following
table unless otherwise amended by these conditions.
Plan No. Rev. Plan/Document Name Date
DA-7000 4 Signage plan, prepared by Alleanza Architecture 12.07.2019
Applicant’s Request
The applicant states the following in support of their request:
“Our clients would like to change the signage elevations (Plan A-7001) with issue number
7, as per the attached V Architecture drawing. There is very little difference between the
two drawing except that the small BP Helios signs would be illuminated. The helios logos
sit within the green LED strip lighting. If it were not for the helios logos the green LED
lighting would have been continuous. Given that, there is effectively no additional
illuminated area. The total area of the illuminated helios signs would be 1.84 m2 (four
helios signs, each 0.46 m2).”
Assessment of Request
The applicant seeks approval for the illumination of the 4 small BP Helios signs (totalling 1.84m 2
of illumination) that are located within the LED Strip lighting on the canopy façade.
An elevation of the proposed signage on site is provided in figure 2 below:
Figure 2 - Elevations of proposed onsite signage
The existing approval permits the illumination of one sign, the pylon sign is currently illuminated.
An LED strip is also illuminated on the canopy façade, with the LED strip on the canopy not
previously regulated by the Noosa Plan 2006 signage requirements.
Since the time of the original approval a Local Law has been introduced which now regulates
advertising devices. Both the LED strip and pylon sign are included as illuminated signage under
the Local Law.
Section 30
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
In regards illuminated signage the Local Law permits:
8 b)
ii) the number of illuminated signs displayed on a premises must not exceed a
maximum of –
a) 1 illuminated sign per tenancy; or
b) If the premise are located on a street corner- 1 illuminated sign per street
front boundary per tenancy
In this instance, as the site is located on a street corner, the existing 2 illuminated signs comply
with the Local Law. Additional illuminated signage is not consistent with the current signage
outcomes sought for the Shire and is prohibited. The proposed additional illuminated signage
does not comply with the existing approval or the Local Law.
4. CONSULTATION
4.1 Other Referrals
The application was forwarded to the following internal Council specialists:
• Environmental Health provided the following comments:
“Environmental Health does not support a 4am operating start time as there are multiple
residences within 150m of the site and it is highly likely this proposal will adversely impact
those residents posing a nuisance at an unreasonable hour. Although noise mitigation
measures are to be implemented, Environmental Health does not deem it appropriate to
move further away from the 7am start time noted in the planning scheme code referenced
below, or extend the hours of operation from the previous operating hours operating at the
site.”
• Local Laws Officer provided the following comments:
In relation to a new application from BP for signage please see below:
• Any new signage application will be assessed against the current signage
requirements in the Local Law.
• In regards to illuminated signage – the current Local Law allows for 1 illuminate sign
per street frontage. The inclusion and addition of illuminated helios signs and the
stripe would not be allowed as this would exceed the allowable total of 1 per street
frontage.
• The Local Law prohibits more than 1 illuminated sign per street frontage.
5. CONCLUSION AND REASONS FOR DECISION
The proposed requests for earlier trading hours and additional illumination signage raises
concerns regarding potential impacts on amenity and do not comply with the relevant provisions
of the Noosa Plan 2020 / Local Laws. Therefore, the application is recommended for refusal.

6. REPORTS FOR NOTING FOR THE COMMITTEE
3 VEGETATION ASSESSMENT PROJECT UPDATE
Author Principal Environment Officer, Peter Milne
Environment Officer-Vegetation Assessment, Vanessa Moscato
Environment & Sustainable Development Department
Index ECM/ Environment
Attachments Nil.
EXECUTIVE SUMMARY
Council relies on having accurate vegetation mapping in a number of ways. Developments
occurring within the mapped Noosa Plan Biodiversity Overlay will trigger environmental
assessment and conditioning to avoid or mitigate impacts. Natural resource managers use
vegetation maps to help inform management actions such as fire management. Up to date
vegetation mapping allows the measurement of Noosa Environment Strategy environmental
targets.
The Queensland Herbarium Regional Ecosystem mapping, first developed in the 1990s and now
at version 12, is used as a base layer for Council’s vegetation mapping systems. Currently
Council’s vegetation mapping is being reviewed to better inform development assessment and
natural resource management programs. This report provides an overview to Council on the
progress of the current Vegetation Assessment Project.
RECOMMENDATION
That Council note the report by the Principal Environment Officer and the Environment Officer-
Vegetation Assessment to the Planning & Environment Committee Meeting dated 8 March 2022
on the progress of the Vegetation Assessment Project.
REPORT
The Noosa Environment Strategy 2019 aims for no net loss of ecosystem values across the
shire:
Strategy 1.1 Protect and enhance existing ecosystems, vegetation networks and habitats.
Target: By 2030, there is no net loss of ecosystems values across the shire.
Measurement: Every 5 years updated regional ecosystem mapping will be used to identify
changes in the number and extent of regional ecosystems.
Consistent with the Noosa Environment Strategy 2019 a vegetation assessment project has
commenced to help measure the success of a no net loss target.
1. Mapping products
The Queensland Herbarium Regional Ecosystem mapping framework was first developed in the
1990s. Now at Version 12, this mapping is the base layer for Council’s vegetation mapping. The
Queensland Herbarium’s remnant vegetation cover and regional ecosystems are defined at a
scale of 1:50,000, which delineates a minimum area for remnant vegetation of 2.5 hectares in
SEQ. The geology mapping on which the regional ecosystem mapping is based is defined at a
regional scale of 1:100,000. Whilst the regional ecosystem mapping products aim to achieve at
least 80% accuracy across the state, they do not always capture the extent of vegetation
communities at a local level. Furthermore, for ecosystems with less than 40% remaining, the
Page 32 of 57
Section 33
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
mapping over-estimates the extent remaining as a per cent of pre-clearing by 10% (Queensland
Herbarium, unpublished data).
Secondly, land use has altered the landscape in some parts of Noosa Shire and the vegetation
mapping products have not been updated to reflect these changes. Regrowth has to be captured
over time as it matures into High Value Regrowth over a period of 15-20 years and eventually
into remnant vegetation over a period of approximately 30 to 40 years.
Given their ready availability and ease of use, Regional Ecosystem maps are increasingly being
relied on for planning by council, landholders and developers. Regional Ecosystem mapping
informs the Noosa Plan Biodiversity Overlay mapping for development assessment. It informs
local and regional threatened species conservation, foreshore management and is also relied
upon for the purpose of emergency and fire management.
LiDAR has been used to fine scale the mapping of vegetation cover to 1:25,000 which provides
greater accuracy within the overlay. Council’s Biodiversity Overlay covers national and state
environmental interests such as those listed under the Nature Conservation 1992 or the
Environment Protection and Biodiversity Conservation (EPBC) Act 1999. However, the
Biodiversity Overlay also extends to locally significant environmental matters, for example:
• regrowth (apart from High Value regrowth already covered by State mapping)
• riparian buffer zones
• ecological linkages
• under represented vegetation in Noosa Shire
• locally significant vegetation types
2. Vegetation assessment project
A vegetation assessment project was launched in July 2021 to review and update Regional
Ecosystem mapping, in consultation with the Queensland Herbarium. This will better inform:
• Review of Environment Strategy biodiversity targets
• Noosa Plan Biodiversity Overlay Mapping for development assessment
• Koala Habitat Mapping as a requirement of the SEQ Koala Conservation Strategy
• Qld Fire Hazard Mapping which is the basis of Council’s Bushland Reserve Fire
Management Plan
• Queensland Herbarium Version 13 Regional Ecosystem mapping which informs provisions
of the Vegetation Management Act 1999
• Representations to Australian Government on the Environment Protection and Biodiversity
Conservation Act 1999
The project employs a full-time project officer until March 2022 and is funded from Cat D Bushfire
Recovery Funding. Improved base vegetation mapping will better inform fire hazard mapping and
associated bushfire preparedness and response. The position has now been extended to 30
June 2022.
3. Project update
A 1km square grid survey has been applied across the shire. The grid excludes waterbodies,
national parks and conservation reserves. This creates a total of 746 grids to be surveyed. As at
7 February 2022 approximately 120 higher priority grids have been surveyed on the ground by
the Environmental Officer-Vegetation Assessment (see map Figure 1).

4. Where to from here?
The Queensland Herbarium is being informed of potential vegetation mapping amendments
throughout this project. A batch of mapping amendments will be provided to the Queensland
Herbarium toward the end of the project at EOFY for their consideration and endorsement.
Previous Council Consideration
Nil.
Finance
The Vegetation Assessment Project is funded by the CAT D Bushfire Recovery Fund $60,000
and Environment Levy Environment Strategy 2019 Project Funding until 30 June 2022.
Risks & Opportunities
Mapping needs to be updated every two years to capture changes in land use and vegetation
cover, particularly the change in status from regrowth to remnant vegetation. Without regular
updates there is a risk of inaccuracies and poor environmental protection outcomes. This can
result in increased department workload to confirm the mapping through the development
assessment process. The underlying vegetation mapping also informs fire management planning
and any mapping inaccuracies can underestimate or overestimate bushfire hazard. Koala habitat
maps are based on accurate Regional Ecosystem mapping which triggers development
assessment provisions.

has recently commenced.
Other tasks not related to vessel management accomplished by the committee include:
- Comprehensive involvement in the review of Environmental Values and Water Quality
Objectives for the Noosa River by the Department of Environment and Science. This will
fundamentally inform the maintenance of good water quality in Noosa River in the
forthcoming period.
- Submission in the Noosa Areas National Park, including the parks interface with the Noosa
River, creek and lake system.

PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
- Provided a watching brief on algae management in the Noosa River, and its potential
impacts on Main Beach.
- Provided views of Council on reactive items such as dredging proposals and additional
ferry route.
Resourcing
Since the formation of the committee the following significant resourcing issues have been
experienced:
- Departure of the original co-chairs being the MSQ General Manager and the Noosa
Council CEO as well as the Noosa Council Environmental Services Manager.
- The vacancy of the Principal Environment Officer River Strategy and Engagement since
October 2021 (the role has been acting Environment Services Manager).
With the commencement of both the new General Manager MSQ and the new Noosa Council
CEO on the 22 February 2022, and the recruitment of a new full time Principal Environment
Officer – River Strategy and Engagement, commencing on the 15 March, it is anticipated that
river management matters will be better progressed in 2022.
Status of MSQ Speed and Safety Review
MSQ have commenced consultation on a permanent reduction in river speed in the lower
reaches of the Noosa River. The proposal is included in Attachment 1. The proposal has drawn
widespread public interest. It is worthwhile noting that this is the first initiative seeking to improve
river management since endorsement of the Noosa River Marine Zone in 2009, which governed
use of jetskis and waterskiing in the Noosa River.
Status of Anchoring, Mooring and Liveaboards
As outlined in the report to Council at the Planning and Environment Committee meeting dated
10 August 2021, NRSAC had provided a suite of recommendations to MSQ concerning better
regulations of Anchoring Mooring and Liveaboards on the Noosa River. As recently as
December, MSQ had advised that they were considering amendment to its regulations to provide
a specific management solution to the Noosa River, and were in the process of briefing their
Director General and Minister about scope of regulatory reform.
In recent email correspondence, MSQ have advised that they are now pursuing a long term
holistic approach to a range of waterways management, as in its role as regulator for the state, it
is reluctant to apply measures that may move issues in the Noosa River to neighbouring areas in
Sunshine Coast waterways. MSQ do note that they are still considering interim options through
better use of existing regulations and mechanisms.
Committee members are keenly anticipating a further update by MSQ at the NRSAC meeting
scheduled for 9 March 2022.
NRSAC ACTIVITIES IN 2022
Items that are of critical importance in the coming year for the Noosa River include:
- Onboarding the new CEO of Noosa Council and General Manager of MSQ and their active
participation ongoing community governance model for the Noosa River which is unique in
Queensland.
- Being an active participant in the consultation process of the MSQ speed review currently
underway.
- Following up on recommendation and solutions to anchoring, mooring and liveaboards in
the Noosa River with MSQ including development of a gantt chart to plot associated
activities.
- Being a key stakeholder in water planning processes underway in the Noosa River through
the Noosa River Waterway Planning Round Table, in particular the preparation of the
Page 40 of 57
Section 41
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 MARCH 2022
Water Plan for the Noosa River Basin by the Qld Government Department of Resources.
This is a critical process that will influence the health of the Noosa River for decades to
come.
- Consider critical river use nodes arising from stakeholder feedback.
- Continuing to provide a sounding board to Council on various items that are likely to arise
including the Slipway lease renewal and next stages erosion management in the Noosa
River mouth.
In terms of more strategic directions, it is considered that Council should request the following
considerations by NRSAC in 2022:
- Recommending to Council of the future of the “draft” Noosa River Plan – what is it status,
should it be pursued, or what does a better Noosa River policy document look like?
- Recommending to Council of the future of NRSAC – what does a long term community
governance model look like for the Noosa River?
It is noted that the terms of reference for NRSAC include the following objectives:
• Prioritise issues impacting upon the Noosa River and catchment.
• Analyse problems and consider solutions including Initiation of ideas.
• Consider recommendations prepared by Noosa Council and MSQ and provide feedback.
• Support informed discussion and consultation within the community at appropriate times.
• Consider the long term best practice governance for the Noosa River and its catchment
including clear vision and goals.
• Ensure the local Kabi Kabi (Gubbi Gubbi) are effectively engaged and bring a First Nations
perspective to ongoing management of the Noosa River and its catchment.
With the completion of the 2 year term occurring in early 2023, it is considered timely for the
NRSAC to consider these longer term objectives.

PROPOSED NEW 6-KNOT ZONE - NOOSA RIVER
In response to safety concerns raised by user groups and the broader community, Maritime
Safety Queensland (MSQ) is proposing to gazette a 6-knot speed limit on the lower reach of
the Noosa River from Thomas Street to the Noosa River mouth. This is a distance of
approximately 1.8 nautical miles (3.3 km) and will apply to all vessels. The proposed 6-knot
speed limit area can be found on a map on the last page of this document.
The lower reach of the Noosa River is currently subject to a gazetted 20 knot speed limit.
During the Christmas and Easter holiday periods a seasonal 6 knot speed limit applies. The
Noosa River seasonal 6 knot speed limit applies to an area between the port lateral mark
adjacent to the intersection of Weyba Road and Gympie Terrace, and the river mouth.
The proposal would permanently apply the current seasonal 6 knot speed limit and extend
the area approximately 600m upstream.
MSQ would like to receive input from you or your organisation and request the following
questions are answered from you or your organisations point of view.
lf you or your organisation are interested in providing feedback to MSQ, please answer the
following questions and return by email within 30 days of receipt of this letter.
1. Do you agree with the proposed 6 knot zone being gazetted on the Noosa River (see
the map at the bottom of the page);
2. If not, please advise your reason(s) why
3. If not, please advise an alternate option that may be considered;
4. If yes, please advise your reason(s) why;
5. In the interests of safety of persons and vessels on the Noosa River, do you think that
this proposal is the most appropriate;
6. If not, please state your reason(s);
7. Please advise any other considerations you think may be appropriate.
At the end of the 30-day consultation period, the responses will be evaluated to determine if
the speed limits changes will be implemented at this time. Please send your replies to the

5 PLANNING APPLICATIONS DECIDED BY DELEGATED AUTHORITY – JANUARY 2022
Author Development Assessment Manager, Kerri Coyle
Environment and Sustainable Development Department
Index ECM/Subject/ All Applications
Attachments 1. Decisions Issued Under Delegated Authority
EXECUTIVE SUMMARY
This report includes a list of applications decided under delegated authority for January 2022.
There were 27 applications decided during this month under delegated authority, including a
range of material change of use, building works, referral agency and operational works
applications.
RECOMMENDATION
That Council note the report by the Development Assessment Manager to the Planning &
Environment Committee Meeting dated 08 March 2022 regarding planning applications that have
been decided by delegated authority.
REPORT
The Local Government Act 2009 allows, by resolution, a local government to delegate its powers
to the Mayor, CEO, a standing committee or a joint standing committee and the CEO to delegate
those powers to another employee of Council.
Under the current delegations for the Planning Act 2016 the ability to manage, assess and decide
a range of development applications are delegated to officers with the exception of the following
which are reported to Council for a decision:
a) an application for a variation request mentioned in section 61 of the Planning Act 2016 to
vary the effect of the planning scheme;
b) the approval of an application where there is substantial non-compliance with a stated
policy of the Council or a high order provision of the Planning Scheme being a desired
environmental outcome, or an overall outcome of a code;
c) the refusal of any application where Council is the assessment manager;
d) requests for change representations, and change applications to change or delete
conditions that were imposed by Council at an Ordinary Meeting or a Special Meeting;
e) and an application for a proposed development of significant community interest.
It should be noted though that due to the strict time frames of the Planning Act 2016, officers
under the current delegations have the ability to decide an application where the application has
the potential for 'deemed approval'.
In accordance with the current delegations, a wide range of development applications are
decided by Council officers each month, with a limited number of applications reported to Council
for a decision.
Attachment 1 lists applications that are decided by delegated authority during the month of
January 2022 (excluding applications seeking to remove a tree(s) adjacent to a building or
structure).
