PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 10 MARCH 2020
Proposed lot 2 would be accessed via an existing bridge and inspection shows that the
bridge may require some significant maintenance work, potentially burdening Council’s
resources in the future.
The officer report concluded that it was not an appropriate form of development for the land and
would result in adverse planning outcomes, including ecological, flooding and traffic which could
not be resolved by conditions. The proposal was found to not comply with a number of the
Noosa Plan codes applicable to the subdivision, including the Mary River Catchment Locality
Code, Biodiversity Overaly Code and Nautral Hazards Overlay Code, and Reconfiguring a Lot
Code, given the unsuitability of lot 2. The proposal was also found to similarly conflict with the
draft planning scheme requirements.
The applicant subsequently lodged an appeal against the decision seeking that the subdivision
be approved subject to reasonable and relevant conditions.
It is order for Council to defend the appeal and the recommendation is worded accordingly.

It is premature at this stage to provide advice on the likely prospects of the appeal. There will be
costs associated with defending the appeal, particularly if the matter proceeds to trial.
