Figure 1 – Locality Figure 2 – Site Plan Figure 3 – Elevations background The site contains an existing multiple dwelling comprising 6 units. The multiple dwelling consists of 2 rows of three units that are connected by a common wall. Each unit is 2 storeys in height. The ground level of the units comprises an open planned kitchen, living dining area, carport and outdoor terrace area. The upper level comprises 2-3 bedrooms, a bathroom and ensuite. The units are constructed of rendered blockwork and terracotta tiled roofs and are of a Spanish inspired style. The multiple dwelling on the site was approved by Council on 29 June 1995 (Council reference TPC 2830). assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017; and The Noosa Plan 2020. Statutory Process The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’. The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that: the development would not result in substantially different development; the change does not include prohibited development; the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation; where the original application was code assessable, the change would not cause the application to become impact assessable. Statutory Instruments – Planning Scheme The following codes from the Noosa Plan 2020 are applicable to this development: Medium Density Residential Zone Code; Coastal Communities Local Plan Code; Use Code; Works Codes; Applicant’s Request The proposed minor change application seeks a retrospective approval for a roofed patio that was established within the rear yard Unit 6. The roofed patio has dimensions of 5m x 3.2m and a height of 2.4m and is a lightweight open structure. The following development details apply to the existing multiple dwelling: Assessment of Request The proposed development does not increase the plot ratio on the site given the structure remain open and not enclosed. The alterations would result in an additional 16m2 (1.15%) of site cover in accordance with the definitions under the Noosa Plan 2020. Consequently, the proposed development would offer a total site cover of 462m2 (33.95%). The proposed roofed patio provides a 3m setback from its outermost projection to the rear boundary of the site. Consequently, it does not comply with the minimum rear setback of 6m. While not achieving the acceptable outcome, it is considered that the proposed additions comply with Performance Outcome PO12 of the Medium Density Residential Zone Code for the following reasons: the patio roof would provide a high level of amenity for the users of the subject site in that. the deck extension would enhance liveability of the dwelling and promote outdoor living. the roof covering is constructed over the top of an existing paved terrace area and the development will maintain adequate landscaped areas mix of trees and shrubs. the proposed additions are not visible from the street frontage and will be consistent with the predominant character of the area which consists of multiple dwellings in a medium density environment. the patio roof is a low profile, open and lightweight structure and would maintain visual and acoustic privacy for adjoining residents and not unreasonably obstruct views. the proposed extensions will preserve the landscaping located within the eastern side boundary that assists with buffering; cONSULTATION Referral Agencies Not applicable Internal Council Referrals Not applicable conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016.
