               REPORT
               1. PROPOSAL
This application seeks a development approval for Material change of use for a three storey (plus
rooftop terraces) mixed use building comprising Food and drink outlets and Short-term
               accommodation.
At ground level (Figure 3) the proposal comprises four Food and Drink outlet tenancies 669m²
gross floor area and 1 x Short-term accommodation unit located in the north-east corner of the site.
The applicant has advised that the hours of operation for the Food and drink outlets will be in
accordance with AO11.2 of the Business activities code, 6:00 AM till 10:00 PM seven days a week
               and midnight Friday and Saturday.
The first-floor level of the building contains 6 x Short-term accommodation units (3 units will be
               dual key unit configuration).
At the second floor the building contains 4 x Short-term accommodation units (2 of the units will be
a dual key configuration). A combined total of 16 short-term accommodation units over the three
               floors.
At the roof level the building will include two rooftop terraces each with private pools. The terrace
areas are approximately 96 and 85 square metres each (see Figure 3). The rooftop terraces
include 2 wooden pergola structures, 2.7 metres in height. The terraces are positioned well within
the central area of the roof envelope and provide substantial setbacks to all street frontages.
The building will include a large basement to accommodate 43 standard plus 2 tandem carparks,
7 Motor bike spaces and 15 bicycle spaces (see Figure 3 - Basement and Ground level). There is
also a number of storerooms for building services and end of trip facilities and 4 lifts to service the
Short-term accommodation units and ground level. Additional parking areas are proposed
adjacent to the southern side boundary and will accommodate an SRV, 3 additional Motorcycle
spaces and 12 parking spaces (including 1 x PWD spaces).
Vehicle entry and exit to the ground and basement level parking areas will be provided primarily
from Albert Street. Access can also be obtained via Thomas Street via an existing easement. The
access easement is located at the southwestern corner of the site and provides reciprocal access
to the neighbouring property at 6 Thomas Street. The easement is to be retained as part of the
               redevelopment.
Two existing crossovers fronting Gympie Terrace will be closed and reinstated, with an existing
crossover on Albert Street to be repositioned toward the southern boundary to provide the primary
vehicle access to the site. The closure and repositioning of crossovers results in 6 additional on-
street carparking spaces and 8 motorcycle spaces.
The entire site is subject to flooding. Any redevelopment requires habitable floor levels to be lifted
to achieve a minimum flood immunity of 2.7AHD which is approximately 0.7 to 1.2 metres above
the existing ground level. The proposed development’s maximum building height when measured
from ground floor level of 2.7 AHD will be approximately 12.9 metres to the top of the roof terrace
pergola's (approximately 13.9 metres from existing ground level). However, the predominant
building height of the third storey roof and facia when viewed from street level is shown to be
approximately 10.2 metres above the ground floor or approximately 11.5 metres from ground level.
The site is contained within the Tourist Accommodation zone and the Noosaville Local plan. The
Noosaville local plan code includes planning outcomes for the site and designates the site as a
‘key corner’ under the Noosaville Framework and Character Plan. Of note is the requirement for
Thomas Street and a portion of Gympie Terrace to be developed as primary active street frontages.
