GENERAL COMMITTEE MEETING REPORT 17 MARCH 2025
5. HUMAN RIGHTS COMPATIBILITY STATEMENT
In developing this Report, the subject matter has been considered in accordance with the
requirements of the Queensland Human Rights Act 2019. It is considered that the subject matter
does not conflict with any human rights and supports a human rights approach to decision making
by Council. Council representatives will endeavour to act and make decisions under this report in
a manner that is compatible with human rights. This report should be read in conjunction with
Council’s Human Rights Policy.
6. CONCLUSION & REASONS FOR DECISION
The proposed development generally complies with the requirements of the planning scheme and
does not raise any significant issues that cannot be addressed by reasonable and relevant
conditions.
This application seeks a material change of use for a Short term accommodation and Food and
Drink outlets at 203 - 207 Gympie Terrace, Noosaville. The proposed uses are consistent uses
under the Tourist accommodation zone.
The design of the building and site layout is generally in accordance with the Noosaville Local plan
code Framework and Character plan which requires active frontages to develop at the corner of
Thomas Street and Gympie Terrace and a building form which is articulated, three storeys in height
and address street frontages.
Building height relating to the roof top terraces and the architectural presentation of the southern
elevation raises some concerns. Amended plans will be requested to ensure roof top pergolas
and terrace structures are reduced in height and bulk and that areas of blank walls provide
additional design detail and articulation.
Waste management for the proposal was not able to be resolved during the application
assessment. While the applicant maintains that waste can be managed on site and collected on
street, this was not supported by Council’s Waste Coordinator. Conditions have been included
which will require amended plans and technical reports for approval to ensure that waste is stored
and able to be collected on site.
The application is recommended for approval subject to reasonable and relevant conditions.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
