6.2.4 Regional Plan

The proposed development falls within the south-east Queensland region which is covered under
the South East Queensland Regional Plan 2009-2031 (Regional Plan). The Regional Plan covers
Noosa in the north, the New South Wales-Queensland border in the south, and Toowoomba in the
west.

The Regional Plan allocates all land into one of three land use categories; Regional Landscape and
Rural Production Area, Urban Footprint, and Rural Living Area. These categories provide the
spatial context for the regulatory provisions of the Regional Plan. The subject site falls within the
Regional Landscape and Rural Production Area under the Regional Plan and is not within the
identified Urban Footprint boundaries.

The Regional Landscape and Rural Production Area identify land with regional landscape, rural
production or other non-urban values. It protects this land from inappropriate development,
particularly urban or rural residential development.

The proposed development is identified as an urban activity under the Regional Plan and is
generally consistent with the development outcomes for urban activities outside the Urban
Footprint. Division 2, Section 2.1, Table 2F of the SEQRP SPRP identifies the referral assessment
criteria for Material Change of Use development outside the Urban Footprint where:

        1. A material change of use for an industrial and commercial purpose having a GFA of no
more than 750 m2 on the premises where -
        (a) any incidental retail activity on the premises is no more than 50 m2; and
        (b) any associated outdoor area on the premises is no more than 1500 m2.

The proposed facility is compliant with the provisions of the SPRP because the site:
                                              2
   • has a total footprint less than 750 m
   • will not trigger any incidental retail activity; and
   • does not contain any outdoor areas on the premises.

In addition, the facility will provide a service for community benefit without compromising the
productive capacity of the site by supporting economy and employment provisions of the
Sunshine Coast Regional Council (formerly including the local government area of Noosa Council)
area identified by the Regional Plan as follows:
‘The small rural hinterland centres and surrounding rural production areas will continue to
play an important role in diversifying the Sunshine Coast’s economy and lifestyle. They will
also support the long-term sustainability of rural areas. The encouragement of home-
based businesses and rural enterprises with access to high-speed broadband
telecommunications provides additional economic and employment growth opportunities
         outside the Urban Footprint.’

For these reasons, the proposed development is not considered to trigger referral to SARA for
assessment under the Regional Plan.

6.3 State Legislation – Vegetation Management Act 1999
The Vegetation Management Act 1999 (VMA) is the legislation that regulates vegetation
management and the clearing of native vegetation in Queensland. The VMA, administered by the
