Surrounding Land Uses: The subject site adjoins a multiple dwelling development to the east and currently a vacant lot to the west (approval granted for duplex). A combination of Noosa Scouts (Open Space Recreation Zone) and a multiple dwelling development abuts the site to the south. The following planning scheme overlays are applicable to this application: Natural Hazards Overlay Code (Acid Sulfate Soils, Flood Hazard & Minimum Floor Area) STATUTORY ASSESSMENT: The application has been assessed against the following statutory instruments, including: The South East Queensland Regional Plan; Any applicable state planning policies; The state planning regulatory provisions; and Any applicable temporary local planning instrument. The application has also been assessed against the planning scheme, including the following applicable codes: Noosaville Locality Code; Residential Uses Code; Engineering Works Code; Landscaping Code; and Natural Hazards Overlay Code. The application has been found to generally comply with all applicable statutory instruments. The Noosa Plan technical parameters are outlined below under Table 1 – 111 Gympie Terrace and Table 2 – 113 Gympie Terrace, with the areas of non-compliance discussed thereafter. Table 1 – 111 Gympie Terrace, Noosaville Criteria Planning Scheme Proposal Complies Population density 7.28 persons max 6.6 persons Gross floor area 327.6m² max 321.4 m² Site cover 40% max 38.5% Landscaped open space Proposed pop x 30m² Soft landscaping 198m² min 118.8 (min 60% soft) 278.1m2 277.5m2 Building height storeys metres 2 storeys max 8 metres 2 storeys 8.5 metres X Boundary setbacks Frontage Side Side Rear 6 metres min 1.5/2 metres min 1.5/2 metres min 6 metres min 8.1 metres 1.51/3.4 metres 4.41/4.42 metres 5.65 metres X Length of wall 15 metres max 11.1 metres Carparking 3 4 (covered) Table 2 – 113 Gympie Terrace, Noosaville Criteria Planning Scheme Proposal Complies Population density 6.15 persons max 5.7 persons Gross floor area 276.75m² max 276m² Site cover 40% max 37.2% Landscaped open space Proposed pop x 30m² Soft landscaping 171m² min 102.6 (min 60% soft) 278.1m2 277.5m2 Building height storeys metres 2 storeys max 8 metres 2 storeys 8.57 metres X Boundary setbacks Frontage Side Side Rear 6 metres min 1.5/2 metres min 1.5/2 metres min 6 metres min 7.3 metres 2.95/2.95 metres 1.8/2.77 metres 5.4 metres X Length of wall 15 metres max 10.2 metres Carparking 3 4 (3 covered & 1 uncovered) Height The proposal seeks a height of 8.57m for the duplex at 113 Gympie Terrace and 8.65m for the duplex at 111 Gympie Terrace (relative to NGL). The proposal is required to meet the minimum floor level of 2.77m AHD which results in approximately 1.493m of fill. The insert below shows the extent of roof that exceeds the 8m above NGL. Given that a significant difference exists between the NGL and the minimum floor level is it reasonable to allow some height dispensation. The highest point of both development includes the roof form which is centrally located along ridge lines which will not cause shadowing, overlooking and does not add to building bulk. The proposed building height is consistent with surrounding development with a recent approval granting a building height of 9.1m for a duplex directly to the west at 109 Gympie Terrace. The proposal is therefore recommended for approval. Rear Setback Probable Solution S9.1 of the Noosaville Locality Code seeks a minimum rear boundary setback of 6.0m if in the Attached Housing Zone. The minimum setback is sought to provide amenity for users of the premises as well as preserve the visual and acoustic privacy of adjoining properties. The minimum setback further sought to ensure vegetation can be retained to provide screening and developments maintain the visual continuity and pattern of building and landscape elements. The application proposes a rear building setback of 5.65m (113 Gympie Terrace) and 5.4m (111 Gympie Terrace. Although encroaching, both building setbacks are reasonable and unlikely to impact adjoining residents to the south based on grounds which include: Multi-residential development to south has significant setback to subject site rear boundary with the inclusion of easement; Other adjoining lot (Scouts) is a non residential use and will not be impacted by 600mm building encroachment; Adjoining multi-residential development FFL are raised and higher to proposed fill on site. This offsets building bulk; Good screening vegetation proposed within site to screen ground floor of development. Other Referrals The application was forwarded to the following internal council specialists: Development Engineer, Engineering and Environment Assessment Branch Environment Officer, Engineering and Environment Assessment Branch Their assessment forms part of this report. CONCLUSION: The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that can not be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. A detailed check of the calculations and drawings has not been undertaken, as they have been certified by a RPEQ. The RPEQ bears full responsibility for all aspects of the engineering design. Council reserves the right to require further amendments and/or additions at a later date should design errors become apparent. Council reserves the right to call up any performance bond held or levy charges against the property, should emergency works be required to be undertaken by Council to make the work site safe due to inactivity on the development site for extended periods of time. Should any changes or modifications to the approved plans be required as a result of construction constraints, a “Request to Change an Existing Approval” under the Sustainable Planning Act 2009 must be made. Amended plans clearly indicating the changes must be lodged with this application along with the appropriate fees. Prestart, On and Off Maintenance Inspections Request Contact Council on 5329 6291 to arrange a prestart or an inspection giving a minimum of 5 business days notice of preferred inspection time. It should be noted prior to arranging a prestart meeting the Right of Appeal Period of 20 business days should have been passed or the applicant has have confirmed by a letter or an email that he/she has accepted the conditions of Decision Notice and waived his/her appeal right. If Council officers are required to undertake additional inspections of the same works, a reinspection fee will be applicable in accordance with Council’s Fees and Charges register applicable at the time. A minimum maintenance period of 12 months will apply to all municipal works (eg public concrete pathway) and thereafter until such time as the works are performing in accordance with the approved design unless notifies otherwise. General Environmental Advisory Note The Environmental Protection Act 1994 states that a person must not carry out any activity that causes, or is likely to cause, environmental harm unless the person takes all reasonable and practicable measures to prevent or minimise the harm. Environmental harm includes environmental nuisance. In this regard persons and entities, involved in the civil, earthworks, construction and landscaping phases of this development are to adhere to their ‘general environmental duty’ to minimise the risk of causing environmental harm. 8.
