3 NOISE TARGETS

3.1 CONDITION 5

In accordance with Condition 5 of Judgement No. 765 of 2020 (3 September 2020) the development will be
assessed in accordance with the criteria below for impacts onto Lots 17-19. Lot 21 is a commercial site and
the following targets are not applicable.

3.2 CONDITION 70

The original DA for the shopping centre included condition 70 below regarding air-conditioning equipment.

70. An occupier of premises where there is air-conditioning equipment must not use or allow the use of the
equipment —

a) before 7am or after 10pm on any day if it maker noise or causes noise to be made of more than the higher
of the following -

0) 40 dB(A);
ii) 3 dB(A) above the background noise level

b) from 7am to 7pm on any day if it maker noise or causes noise to be made of more than the lower of either
of the following:

i) 50 dB(A)
ii) 5 dB(A) above the background noise level

©) from 7pm to 10pm on any day if it makes noise or causes noise to be made of more than 3 db(A) above the
background noise level.
