Ordinary Meeting Minutes, 23 October 2014, Item 7, Page 6
That Council note the report by the Property and Facilities Manager to the Planning &
Organisation Committee Meeting dated 14 October 2014 and:
A. Grant a 12 month permit to occupy to the Noosa Heads Surf Lifesaving Club over Lot 165
MCH 5180 to enable it to establish surf lifesaving activities at Peregian Beach;
B. Authorise the CEO to enter into negotiations for a 20 year lease to the Noosa Heads Surf
Lifesaving Club over Lot 165 MCH 5180 for surf lifesaving and ancillary activities at
Peregian Beach; and
C. Apply the exception to the requirement for tendering of the lease under Section 236 (1) (b)
(ii) of the Local Government Regulation 2012 as the lease is to a community organisation.
Finance
The recommended response to the EOI process in this report maintains a similar Council
financial commitment for the Peregian Beach Surf Club building and notes future service level
increases or capital expenditure would occur via Council’s normal community grant funding
program or via standard asset management activities (including maintenance and renewal
forecasts).
Consistent with the EOI process undertaken and previous Trustee Permits offered at the site,
rent revenue for the recommended Trustee Permit is proposed at 1 Unit in accordance with
Council’s adopted fees and charges.
Risks & Opportunities
Risks
There is risk the unsuccessful respondent to the EOI will be aggrieved with the EOI outcome but
Council has undertaken a fair and reasonable public process subject to independent probity
review.
Opportunities
The EOI process was undertaken to allow Council to explore opportunities to activate
underutilised space at the building, in line with its Community Purpose Land and Infrastructure
Tenure Policy.
The recommendation seeks to provide a new Trustee Permit to enact a new strategic plan to
establish a new local surf club entity and deliver significant community benefit, an outcome
Council has been seeking for a number of years.
The recommended Trustee Permit also seeks to facilitate other community groups’ use of the
upper level, where it does not compromise surf life saving activities from the site.
