Condition 5
The applicant seeks to reduce the bond from $30,000 to a suitable amount considerate
of the dual occupancy development and Council infrastructure improvements. PSP6.5
seeks for performance bonds be a reasonable amount having regard to the following:
• Critical site attributes;
• The importance in planning, environmental and engineering terms of the Council's requirements;
• Scale of the specific matters against which security is required;
• The likely degree of community concern should a breach occur; and
• Remedial action, if any can be taken, which may be required should a breach occur.
The site is located on a one-way low impact road and is for a consistent code assessable
dual occupancy use within the Medium Density zone. There are minimal changes to the
frontage and site conditions that would require remedial action and/or likely community
concern. Other similar dual occupancy developments have been conditioned for a $10,000
bond and it is recommended for a similar amount in this instance.
Condition 35 – Approved OPW Plans
The updated plans include amended Engineering and Landscaping drawings consistent
with the updated drawing set. Please amend the condition in accordance with the updated
plans.
