RE: Representations to Infrastructure Charges Notice - MCU18/0157 - 130 Eumundi Noosa
Rd, NOOSAVILLE - Industrial Bus Type 2 (Brewery) & Entertainment & Dining Bus Type 3
(Brew Cafe/Bar)
On the 25 June 2019, Council issued an Infrastructure Charges Notice (N1452) totalling
$23,128.00.
In accordance with Section 75 (2) of the Planning Act 2016, the applicant gives notice to Noosa
Council to suspend the applicant’s appeal period relating to the infrastructure charges notice.
Representations
The Infrastructure Charges Notice considers the entertainment and dining business component to
be worth $25,434.66 including an area of 146m2, which is broken up into the following use areas:
- Entertainment and Dining Business is inside the building restricted to 75m2;
- ‘back of house’ bar and kitchen areas take up an area of 55m2; and
- Toilet on the ground floor is 16m2.
The definition of gross floor area (GFA) within the Infrastructure Charges Resolution means the
sum of the floor areas (inclusive of all walls, columns and balconies, whether roofed or not) of all
stories of every building and/or structure attributable to the development use located on a site,
excluding the areas (if any) used for building services, a ground floor public lobby, a public mall in
a shopping centre, and areas associated with the parking, loading and manoeuvring of motor
vehicles.
As the toilet and ‘back of house areas’ are not specifically restricted to be used only in conjunction
with the entertainment and dining use – these areas could also be attributed to be used as part of
the industrial component of the site during the daytime hours. As a result, the applicant considers
the Industrial use area rate be applied to these areas. This would reduce the cost of the charge
amount to the following:
Entertainment & Dining Business (Active Dining Area) = 75m2 ($13,065.25)
Industrial Business = 396m2 (-$131.20)
Total Charge = $12,934
