1. Response to outstanding issues
We consider that the above changes ensure that the proposal complies with PO13 of the Tourist Accommodation Zone
Code, as the building and associated structures are designed and sited to:
provide a boutique mixed use visitor accommodation with a high level of amenity for its guests and adjoining
tenants, by incorporating structural elements and features to achieve adequate visual and acoustic privacy.
ensure any existing views from adjoining premises are not unreasonably obstructed/ obscured or result in
overlooking of private open space or habitable areas.
provides suitable and generally compliant setbacks to adjoining premises and property boundaries
incorporates generous landscape treatments throughout the development to soften the built form and enhance
the visitor experience
provides a high quality mixed use development consistent with the existing and intended character of the area,
whilst enhancing the function and attractiveness of the area as a visitor destination.
We note that our client’s representatives held preliminary discussions with the adjoining owner (unit 7) but have been
unable to obtain a letter of support for the proposal at this time. As a result, to avoid further time delays and expense in
securing the owner’s support, we request that Council finalise its assessment based on the proposed amendments which
we consider address Council’s outstanding concerns with respect to impacts on views and which also demonstrate
compliance with PO13 of the Tourist accommodation zone code.
In light of the above changes, we look forward to Council’s favourable consideration of this application which provides a
highly compliant boutique mixed use development in accordance with the relevant assessment benchmarks of the Noosa
Plan 2020. The proposal has undergone significant amendments to deliver a development consistent with the
requirements of the planning scheme. We consider that by incorporating the latest plan amendments the proposal strikes
the right balance between upholding the provisions of the planning scheme and achieving our client’s intent to deliver a
high quality mixed-use visitor accommodation development which reinforces the Duke St precinct as an attractive tourist
destination.
We trust the revised proposal addresses Council’s requirements and should you have any questions or wish to discuss any
aspect of this response, please do not hesitate to give me call on (07) 3012 0100.
Yours faithfully,
TIMOTHY BALCOMBE
