The proposed development comprises of two units which are accessible from a common driveway, which runs parallel to the northern side boundary. Both units are 2 storey, contain 2 bedroom dwellings with double car garages and are symmetrical in design when viewed from the internal driveway. Each unit will have a swimming pool with each pool located along the southern boundary, and setback 2 metres from the front boundary. Both swimming pools are less than 1 metre above ground level. The applicant seeks siting variations for the front and rear boundary setbacks. The proposed front boundary setback is 5.5 metres in lieu of 6 metres relating to the roof of the outdoor entertaining area. The proposed rear boundary setback is 3.5 metres in lieu of 6 metres. The rear boundary encroachments relates to the outdoor entertaining area, and upper level eave. Each unit has a 3,000 litre water tank dedicated for non-potable purposes located under driveway manoeuvring areas. Each unit has a ‘services room’ which relates to exhaust from kitchen appliances, air conditioning units etc. The ceiling height is reduced to 1.5 metres and is not a habitable room, this area avails the ability to screen the services without encroaching in areas of open space, see Figure 10. The locality and proposal plan are included below. PLM22/0003) was carried out earlier in the year for the purpose of a single dwelling house, in excess of site cover provisions. Following feedback from Council in regard to site cover provisions the subject development application was lodged for the purpose of a Dual occupancy. The subject site has been rezoned Medium Density where previously Low Density Residential in the Noosa Plan 2006. Site Description The subject site has 15 metres of frontage to Coral Tree Avenue. The site is 606 square metres in size with the land falling to the road. Surrounding Land Uses The surrounding area predominately consists of single dwelling houses, with the exception of the unit development adjoining the premises to the north of the site. assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017; and Noosa Plan 2020 (25 September 2020). Noosa Plan 2020 The following codes from the Noosa Plan 2020 are applicable to this development: Medium Density Residential Zone Code; Noosa Heads Local Plan Code; Dual Occupancy and Multiple Dwelling Use Code; Works Codes. The subject site is located in Noosa Heads and is zoned Medium Density Residential. The proposed use is identified as a consistent use within the zone and is required to follow a code assessable application process. The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below: Criteria Planning Scheme Proposal Complies Land Area 607m2 Building height storeys metres 2 storeys max 8 metres 2 storeys 7.5 metres Site cover 40% max 38.4% Plot ratio 242.8m² max 0.40:1 max. 241.3 m² 0.39.7:1 Boundary setbacks Frontage Side Side Rear 6 metres min 1.5/2.0/2.5 metres min 1.5/2.0/2.5 metres min 6 metres min 5.5 metres 1.5/2.0/2.5 m 1.5/2.0/2.5 m 3.5 metres X X Length of wall 15 metres max 13.5 metres Landscaped open space Soft landscaping 242.8 m² min (40%) 145.68 min 60% of total ~220 m² >145m² X Private Open Space 25m² min >25m² Carparking 2 covered min 1 uncovered min 4 covered 1 uncovered Non-Potable Water Min 3,000 litres/unit 2 tanks 3k L Setbacks Front Setback AO12.1 Buildings and structures meet the following minimum boundary setbacks: for frontages — 6 metres for side boundaries— 1.5 metres setback up to 4.5 metres height; 2 metres setback between 4.5 metres and 7.5 metres height; and 2.5 metres where above 7.5 metres height for the rear boundary - 6 metres AO12.2 The front 6 metres of the property is landscaped open space, provided that uncovered visitor parking, or swimming pools protruding no more than 1 metre above the ground level, can be as close as 2 metres from the front boundary. PO12 Buildings and structures are designed and sited to: provide a high level of amenity to users of the subject site and adjoining premises, including provision of visual and acoustic privacy; not unreasonably obstruct views or cause overlooking of private open space or habitable areas of adjoining premises; provide adequate distance from adjoining land uses; preserve existing vegetation that will help buffer development; allow for space and landscaping to be provided between buildings including adequate area at ground level for landscaping with trees, shrubs, outdoor living and utilities; be consistent with the predominant character of the surrounding area; and protect the natural character and avoid adverse impacts on ecologically important areas such as national parks, waterways and wetlands. The applicant seeks a front boundary setback of 5.5 metres to the front boundary in lieu of 6 metres. The area of encroachment relates to 0.5 of a metre of the alfresco area of Unit 1 for a distance of 2.5 metres. The non-compliance is central to the building and will not impact on adjoining premises visual or acoustic privacy. Upon site inspection and review of the streetscape setback analysis provided by the applicant, there are several siting relaxations within close proximity to the subject site on both roadsides, see Figure 9. The proposed boundary relaxation will not form a dominant feature of the streetscape in consideration of the proposed finishes and trees species, and the setback is consistent with the character of the street and surrounding area. The development fulfills the Performance outcome. Setback A rear boundary setback of 3.5 metres is proposed, not in compliance with AO12.1(c) of the Medium Density Residential Zone Code. The boundary relaxation relates to the outdoor area and upper level eaves of Unit 2, relating to roof only. The rear of the site is subject to earthworks with approximately a metre of cut proposed. The area of land between the retaining wall and the rear boundary fence is proposed to be landscaped and as a consequence the appearance of the structure from adjoining side boundary and any future development of the vacant property along the rear will be softened. The proposed siting of the alfresco area is not considered to compromise the amenity or privacy of adjoining premises. The development is considered to comply with Performance outcome PO12. The applicant has not confirmed the siting of the pool equipment within the side/rear boundary setbacks, and a condition has been imposed to ensure compliance with Acceptable outcome AO21.3 relating to setbacks and landscaping for equipment . It is likely that the siting of equipment such as a pool pump will be located within the 2 metres boundary setback and, a condition will be imposed that should the siting of the equipment not be setback 2 meters the equipment is to be baffled. Side Boundary Fence Height The applicant is seeking to undertake cut and fill across the site and are constructing retaining walls in response to the finished ground level. The fencing height provided on the architectural plans do not correlate with the earthworks plans. To ensure that the side boundary fence height does not exceed 2 metres and place adverse impacts on adjoining landholders a condition will be imposed that the fence height is not to present a height greater than 2 metres from adjoining premises. Street Trees Council’s Senior Environmental Officer, and Council’s Development Engineer, have discussed replanting of street in the road reserve. Consequence of the extent of underground infrastructure in the road reserve and sight lines, trees have not been conditioned to be provided. cONSULTATION Referral Agencies Not Applicable Internal Council Referrals The application was forwarded to the following internal Council officers for review and/or comment: Development Engineer The submitted documentation did not include sufficient information for Engineering to assess the proposed development (sustainable building design, sight distances, vehicle manoeuvring, and lawful point of discharge). The applicant engaged Ingeniir Consulting to address Council’s concerns. Ingeniir conducted an assessment and concluded that the proposed development complies with all relevant sight distance, vehicle manoeuvring and sustainable building requirements. Ingeniir indicated that the existing water meter is to be upgraded to a trafficable lid and that the proposed development is not considered to create a worsening of flows. Engineering believes relevant compliances can be achieved and recommends the following conditions be included. conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016.
