Our ref: 251011 Council ref: MCU23/0038.01 04 November 2025 The Chief Executive Officer Noosa Shire Council PO BOX 141 Tewantin, QLD, 4565 Attention: Development Assessment Via email: [email protected] To the assessment Manager, Re: Request for a Minor Change to Development Approval Material Change of Use to Establish Aquaculture 14-16 Action Street, Noosaville Lot 290 MCH 811938 Council ref: MCU23/0038.01 Please find enclosed a Change Application in relation to the approved Material Change of Use to establish Aquaculture (Council ref: MCU23/0038.01). This Change Application is made under Section 78 and 79 of the Planning Act 2016, on behalf of the applicant, Provectus Algae Pty Ltd. In support of the request please find enclosed the following: Attachment 1 – Site Plan prepared by Wilson Architects. Attachment 2 – Engineering Plans prepared by Northern Consulting Engineers. Attachment 3 – Title Search. Payment of the application fee will be made upon Council issuing the relevant invoice. Background The site is zoned Medium Impact Industry and has a total area of 6,778m², with separate ingress and egress provided from Action Street (refer to Figure 1 below). The subject site is located within an established industrial area and is surrounded by a mix of industrial uses. A Development Permit for Aquaculture was issued on 14 September 2023 (Council Ref: MCU23/0038). The aquaculture facility was approved to operate within an existing industrial shed (approximately 1,112m² in area) and two additional structures (approximately 380m²) which have since been removed. This approval was acted upon. On 14 December 2023, a minor change application (Council ref: MCU23/0038.01) was approved to address vegetation affecting neighbouring properties. An arborist was engaged to remove the vegetation. Council subsequently advised that an application was required to amend the existing Development Approval to lawfully remove the landscaping. This additional approval was then obtained and acted upon. Page 1 of 4 Our ref: 250311

Proposed Changes
This change application seeks approval for a new shed on the site, comprising approximately 54m² of gross floor
area (GFA), located along the northern boundary as shown in the Site Plan prepared by Wilson Architects
(Attachment 1). As the two smaller structures along the western boundary have been removed, the total GFA
on the site, including the proposed industrial shed, will be 1,166m². The proposed shed will be setback 3m from
the side boundary, which is compliant with the Medium Impact Industry Zone Code.

Figure 2 Proposed Site Plan (Source: Wilson Architects 2022)
The original approval includes a condition requiring a minimum of 17 car parking spaces to be provided, marked
on-site, and made available and accessible at all times for staff and visitors while the use is operating. The
proposal to facilitate a new shed involves 8 car spaces to be removed and relocated. Overall, the site provides
for 33 car spaces, which represents a surplus of parking spaces. Based on the minimum parking requirement for
aquaculture in an Industry Zone, the required number of spaces remains at 17 car spaces.
Based on the changes proposed, it is requested that Condition 2 be updated to reflect the amended Site Plan as
follows:

Change Application - Planning Act 2016
The proposed changes to the Development Permit and associated conditions, are considered a ‘Minor Change’
under section 78 of the Planning Act 2016, as:
The proposed changes will not result in a substantially different development to that which was
approved, given that:
o The proposal does not involve a new use;
o The proposal does not involve a new parcel of land;
o The industrial shed will not dramatically change the built form in terms of scale, bulk or
appearance compared to what was approved;
o The proposed industrial shed will not affect the ability of the development to operate as
intended;
o The proposal does not remove a component that is integral to the operation of the
development;
o The proposal does not impact traffic flow or the transport network, such as increasing traffic
to the site;
o The proposal does not introduce new impacts or increase the severity of known impacts;
o The proposal does not remove an incentive or offset component that would have balanced a
negative impact of the development; and
o The proposal does not affect infrastructure provision.
