We are the long term owners of lot 25 apartment 28 at Offshore Noosa which is in close
proximity to both of the commercial take away shops Lot 3 and Lot 33 and have firsthand
knowledge, over many years, with problems associated with these businesses., This mainly
occurs when there have been a change of ownership and or proprietorship and the new
tenants start pushing the boundaries in order to maximise their patronage and profits whilst
disregarding the common rights of the residential unit owners.

The problems have always been associated with noise, parking, cleanliness and disposal of
waste and garbage. The Body Corporate has had to intervene on behalf of the residential lot
owners on numerous occasions to enforce the rules and regulations and on at least two
occasions was forced to use the services of Noosa Council to take action on these issues.
The disputes specifically related to onsite parking and noise coming from the plant,
equipment and exhaust fans installed in the Elvis Caf6 which has since been renamed Riva
Caf6.

We believe upgrading the Riva Caf6 to an entertainment and dining business will only
aggravate the fragile situation that exists at the moment and accordingly we wish to lodge an l

objection to TWX fty Ltd application on the following grounds:

   1. The proposed hours of trading are unreasonable considering the resort is primarily
      used for residential tenancy.
   2. There is no available on-site parking for their customers.
   3. There is no adequate sound proofing to restrict noise coming from the proposed
      outside dining areas.
   4. There are no plans to change the existing exhaust fan capacity to cope with the
      additional loads and usage.
