That Council note the report by the Development Planner to the Ordinary Meeting dated 30 April
2020 regarding Planning & Environment Court Appeal No. BD897 of 2020 and defer consideration
of the matter to the May round of meetings to allow Councillors to obtain further information.

That Council note the report by the Development Planner to the Ordinary Meeting dated 30 April
2020 and the further report by the Manager Development Assessment to the General Committee
Meeting dated 18 May 2020 regarding Planning & Environment Court Appeal No. BD897 of 2020
and agree to defend the appeal
Finance & Risks
Should Council not wish to settle the appeal, there will be further costs in defending the appeal and
based on the joint expert and Council’s planning solicitor advice, a favourable outcome by trial is
unlikely.
It should be noted that some co-respondents have recently withdrawn from the appeal following the
second joint visual expert report and officer’s advice that they would recommend settlement to
Council. Other co-respondents have advised that when Council resolves its position at the February
round they will adopt the course that Council takes. In the absence of all co-respondents taking a
similar position, the appellants are likely to push to complete the town planning joint expert report
and progress a hearing in March 2021.
