The proposal involves: Replacing existing timber deck Creation of storage area under deck New stairs from deck New colourbond roofing over deck Extension of external half walls around deck The locality and proposal plan are included below. Figure 1 – Locality Figure 2 – photograph of existing development Figure3 – Site Plan Figure 4 – Floor Plan Figure 5 – Roof Plan Figure 6 – Section background A development approval for a Multiple Dwelling of 12 units was issued 29th May 1984. An application to change the Development Permit was issued 8th January 2008 which approved awnings to be established over the lower deck areas. An extract of the approved plans is provided below: A review of aerial photographs and site inspection indicate that the works have commenced with the surrounding deck areas covered. assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017; and The Noosa Plan 2020. Statutory Process The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’. The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that: the development would not result in substantially different development as the awning is consistent with the use on the site and appearance of the building; the change does not include prohibited development; the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation; where the original application was code assessable, the change would not cause the application to become impact assessable. Statutory Instruments – Planning Scheme The following codes from the Noosa Plan 2020 are applicable to this development: Medium Density Residential Zone Code; Noosaville Local Plan Code; Dual Occupancy and Multiple Dwelling Code; Works Codes; Flood Hazard Overlay Code. The proposed works have been reviewed against the plans approved as part of the 2008 change application and are generally consistent with those plans. The changes to the deck involve replacement of the existing awning and deck in the same location and height with the awning extending over this deck in a similar alignment to the adjoining unit. The new awning and deck whilst not compliant with the current scheme setback requirements is consistent with the 2008 change approval and reflects the pattern of development in the area. The proposed awning is lightweight, does not reduce landscape open space provisions on site and the façade of the building is setback 6m from the boundary of the site. A condition requiring the deck to remain open is recommended to be included in the approval. cONSULTATION Referral Agencies Not applicable conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016.
