Development Assessment Report
PROJECT URBAN – 16216 February 2021
7.0 STATE PLANNING INTERESTS
The Planning Regulation 2017 prescribes assessment benchmarks that an application must be
assessed against, which are additional or alternative to the benchmarks contained within local
planning instruments. The assessment benchmarks are contained within:
• The Regional Plan and Part E of the State Planning Policy, to the extent that they are not
appropriately integrated into the Planning Scheme; and
• Schedule 10 of the Planning Regulation 2017.
Part E of State Planning Policy, the SEQ Regional Plan and Schedule 10 of the Planning Regulation
are addressed below.
7.1 SOUTH EAST QUEENSLAND REGIONAL PLAN
The site is subject to the South East Queensland Regional Plan 2017 (regional plan). Under the
regional plan, the subject site is included within the Urban Footprint and the proposed
development which comprises a range or urban related uses is entirely consistent with this
designation. On this basis, no further assessment against the SEQ Regional Plan is necessary.
7.2 STATE PLANNING POLICY
The State Planning Policy (SPP) defines the Queensland Government’s policies about matters of
state interest in land use planning and development. The SPP only applies to development
assessment if the Planning Scheme has not yet appropriately integrated the SPP. If there is a
discrepancy between a local planning scheme and the SPP, then what is outlined in the SPP
overrides the Planning Scheme.
Section 2.1 of the Noosa Plan 2020 confirms that the SPP has been appropriately integrated into
the plan except for the part of the Natural hazards, risk and resilience policy relating to erosion
prone areas in coastal areas. As the application site is not located in an erosion prone area identified
on the SPP interactive mapping, no further assessment against the SPP is required.
7.3 STATE DEVELOPMENT ASSESSMENT PROVISIONS
The State Development Assessment Provisions (SDAP) set out the matters of interest to the state
for development assessment, where the state assessment and referral agency (SARA) is responsible
for assessing or deciding development applications as assessment manager or as a referral agency.
The SDAP is not applied by local government in the assessment of development applications.
A review of Schedule 10 of the Planning Regulation 2017, has confirmed that the proposed
development does not trigger referral to any State agencies and as such, the SDAP is not applicable
to the application.
