Author Developmnet Planner, Glen Conforti Development Assessment APPLICATION DETAILS Application No. MCU18/0062 & OPW18/0084 Applicant Building Suncoast Green Proposal Material Change of Use for Ancillary Dwelling Unit, Industrial Business Type 2 - Production alteration repackaging Properly Made Date 19 April 2018 Information Request Date 2 May 2018 Information Response Date 1 June 2018 Decision Due Date 16 July 2018 Report Completed Date 5 June 2018 Number of Submissions Not Applicable PROPERTY DETAILS Property Address 6 Vision Ct Noosaville Qld 4566 RP Description Lot 7 SP 295958 Land Area 1867m² Existing Use of Land Vacant STATUTORY DETAILS SEQRP Designation Urban Footprint Locality Noosaville Zone Industry Overlays Natural Hazards Overlay – Low potential acid sulfate soils Assessment Type Code PROPOSAL The application seeks approval for a Material Change of Use - Ancillary Dwelling Unit, Industrial Type 2 Production alteration repackaging. The development consists of tilt panel construction with the driveway and carparking along the eastern side of the lot. The development includes 7 tenancies, 3 tenancies with 65m² Ancillary Dwelling Units and 4 tenancies with mezzanine floors of around 59m² each. Figures 1 and 2 below show the proposal. Figure 1 - Street perspective Figure 2 - Floor layout including the mezzanines site details Site Description Surrounding Land Uses The site is located in an industrial estate and characterised by typical industrial complexes. assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017 The Noosa Plan. The following codes from the Noosa Plan are applicable to this development: Noosaville Locality Code Business Uses Code Landscaping Code Engineering Works Codes The subject site is located in the Noosaville Locality and is zoned Industry. The proposed use is defined as a consistent use in the zone and is required to follow a code assessable application process. The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below: Criteria Planning Scheme Proposal Complies Site Area 1864m² Landscaping 15% min 279m² 280m² Building height storeys metres 10 metres metres Boundary setbacks Frontage (primary) Rear Side (east) Side (west) 6 metres min 0 metres min 0 metres min 0 metres min 4.5m to 6.5m 3m 12.75m 0 metres X Carparking 18 spaces – Industrial businesses 3 spaces – Ancillary dwelling units 17 plus 3 motor cycle (~ 18) 3 spaces Bicycle Spaces End of Trip Facilities* *(required only where 5 + spaces are required) 11 bicycle spaces 1 locker per 2 bicycle spaces and; 1 shower cubicle with ancillary change room per 10 bicycle spaces 7 bicycle spaces 7 lockers 7 shower cubicles X Front Setback The proposal seeks a 4.5m setback to the western portion of the building. The front boundary is an odd shape and the balance of the building is setback between 5.1m and 8.3m with the building stepped to complement the shape of the boundary. It is considered the setback is sufficient given the shape of the boundary and the landscaping between the boundary and the building will provide softening of the development. Bicycle Parking The development proposes 7 bicycle spaces rather than the Probable Solution S31.2 of the Business Uses code which requires 11 spaces. In this instance it is considered that 7 spaces is sufficient. It is noted that bicycles are usually parked within the tenancy where there would be sufficient space for more than 1 bicycle. cONSULTATION Other Referrals The application was forwarded to the following internal Council officers: Development Engineer; and Environmental Officer. conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016. For the purpose of this condition, an effectively stabilised surface is defined as one that does not, or is not likely to result in visible evidence of soil loss caused by sheet, rill or gully erosion or lead to sedimentation, or lead to water contamination. Environment - Erosion and Sediment Control Prescribed Water Contaminants (as defined in the Environmental Protection Act 1994) must not be released from the site or to waters within the site, or be likely to be released should rainfall occur, unless all reasonable and practicable measures are taken to prevent or minimise the release and concentration of contamination. Erosion and sediment control measures must be installed and maintained to minimise erosion on the site and to minimise the export of sediment and associated pollutants from the site. The erosion and sediment control measures must be designed, installed and maintained in accordance with current best practice standards (refer to advisory notes). Prior to the final inspection for the development, all site surfaces must be effectively stabilised using methods which have achieved effective short-term stabilisation and which will continue to achieve effective stabilisation in the medium to long-term (refer to advisory notes). For the purpose of this condition, an effectively stabilised surface is defined as one that does not, or is not likely to result in visible evidence of soil loss caused by sheet, rill or gully erosion or lead to sedimentation, or lead to water contamination. Limit soil exposure on the site to a distance of no more than 2m beyond the extent of earthworks shown on the approved plans except where the exposed soil is effectively stabilised without delay and prior to rainfall occurring. Advisory notes The following notes are included for guidance and information purposes only and do not form part of the assessment manager conditions: The following notes are included for guidance and information purposes only and do not form part of the assessment manager conditions: PLANNING Aboriginal Cultural Heritage Act 2003 There may be a requirement to establish a Cultural Heritage Management Plan and/or obtain approvals pursuant to the Aboriginal Cultural Heritage Act 2003 (ACH Act). The ACH Act establishes a cultural heritage duty of care which provides that: “A person who carries out an activity must take all reasonable and practicable measures to ensure the activity does not harm Aboriginal cultural heritage”. It is an offence to fail to comply with the duty of care. Substantial monetary penalties may apply to individuals or corporations breaching this duty of care. Injunctions may also be issued by the Land and Resources Tribunal, and the Minister administering the ACH Act can also issue stop orders for an activity that is harming or is likely to harm Aboriginal cultural heritage or the cultural heritage value of Aboriginal cultural heritage. You should contact the Cultural Heritage Unit on 07 3247 6212 to discuss any obligations under the ACH Act. Equitable Access and Facilities The plans for the proposed building work have NOT been assessed for compliance with the requirements of the National Construction Code - Building Code of Australia (Volume 1) as they relate to people with disabilities. Your attention is also directed to the fact that in addition to the requirements of the National Construction Code as they relate to people with disabilities, one or more of the following may impact on the proposed building work: the Disability Discrimination Act 1992 (Commonwealth); the Anti-Discrimination Act 1991 (Queensland); and the Disability (Access to Premises – Buildings) Standards. Development Compliance Inspection Prior to the commencement of the use, please contact Council's DA Planning Section to arrange a Development Compliance Inspection. INFRASTRUCTURE CHARGES This Development Permit will trigger an “Infrastructure Charge Notice” to be issued in accordance with Council’s “Charges Resolution” made pursuant to the planning legislation and regulations current at the time of issue. ENGINEERING General Advisory Notes Council has undertaken an audit check of the Operational Works drawings in relations to the proposed works. A detailed check of the calculations and drawings has not been undertaken, as they have been certified by a RPEQ. The RPEQ bears full responsibility for all aspects of the engineering design. Council reserves the right to require further amendments and/or additions at a later date should design errors become apparent. Council reserves the right to call up any performance bond held or levy charges against the property, should emergency works be required to be undertaken by Council to make the site safe due to inactivity on the development site for extended periods of time. Should any changes or modifications to the approved plans be required as a result of construction constraints, a “Request to change an existing approval” under the Sustainable Planning Act 2009 must be made. Amended plans clearly indicating the changes must be lodged with this application along with the appropriate fees. Prestart Contact Council on 5329 6245 to arrange a prestart or an inspection giving a minimum of 5 business days’ notice of preferred inspection time. It should be noted prior to arranging a pre-start meeting the Right of Appeal Period of 20 business days should have been passed or the applicant has have confirmed by a letter or an email that he/she has accepted the conditions of Decision Notice and waived his/her appeal right. If Council officers are required to undertake additional inspections of the same works, a reinspection fee will be applicable in accordance with Council’s Fees and Charges register applicable at the time. Environmental Advisory Notes The Environmental Protection Act 1994 states that a person must not carry out any activity that causes, or is likely to cause, environmental harm unless the person takes all reasonable and practicable measures to prevent or minimise the harm. Environmental harm includes environmental nuisance. In this regard persons and entities, involved in the civil, earthworks, construction and landscaping phases of this development are to adhere to their ‘general environmental duty’ to minimise the risk of causing environmental harm. Erosion and Sediment Control Accepted best practice standards include: Best Practice Erosion and Sediment Control, International Erosion Control Association (2008). As a general rule, a site is determined to have achieved effective short-term stabilisation if at the time of the plan sealing inspection: Methods of stabilisation are: appropriate for slopes and slope lengths; and are consistent with best practice environmental management practices such as in the Manual for Erosion and Sediment Control or the IECA Manual; and Stormwater runoff from the site is not currently, and is not likely to result in visible evidence of sedimentation or erosion, or lead to water contamination. If at the time of request for plan sealing, the method of short-term stabilisation has not achieved a level of stability that Council's Officers believe will have a high probability of achieving long term stability (i.e. until house construction has occurred on all lots), Council Officers may take the following matters into consideration in determining whether the site is capable of achieving medium to long-term stability: evidence that the site has been effectively stabilised in the short term; evidence that soil has been adequately ameliorated; evidence that seed of annual and perennial grass species has been applied at an adequate rate; and that grass seed has germinated at a density that is likely to achieve an effective grass cover. Building and Construction Industry (Portable Long Service Leave) Levy Where it is required, the QLeave levy should be paid prior to arranging the prestart meeting. The details that the Levy has been paid must be submitted to Council prior to the prestart. QLeave contact: 1800 803 481 (free call) or (07) 3212 6855 property notes Not applicable.
