Council Ref: 152006.1999.4
Our Ref: HBD 6829410
We refer to the abovementioned Change Application, notice of which has
been given to Energex Limited pursuant to section 80 of the Planning Act
2016. As an affected entity for the Change Application, we advise that
Energex objects to the proposed changes.
In carrying out our assessment, we have reviewed the Change Application Enquiries
material submitted to Energex on 29 November 2019, in addition to our Benjamin Freese
historical records for this application. Our assessment has also been Telephone
undertaken against the purposes of the Electricity Act 1994 and Electrical (07) 3664 5097
Safety Act 2002, being primary matters Energex has regard to in carrying out Facsimile
its referral agency and affected entity duties. (07) 3664 9829

Justification for our objection is as follows: energyq.com.au
A development application was originally referred to Energex as an
Corporate Office
advice agency on 30 October 2006. Energex provided a response to 26 Reddacliff Street,
Noosa Shire Council on 28 November 2006, which advised that the Newstead QLD 4006
development may be approved in principle, subject to conditions. A GPO Box 1461
copy of this response is enclosed for reference (refer Attachment 1). Brisbane Qld 4001
Notably, Energex’s referral agency response provides in principle Telephone (07) 3664 4000
support for a perpendicular road crossing of Easement B on Facsimile (07) 3025 8301

We understand that the development application was refused by Sunshine
Coast Council, as directed by the Department of Environment and Resource
Management, on 16 November 2009. This decision was subsequently appealed
in the Planning and Environment Court, with the matter settled on 5 July 2013.
The approved development included an amended Proposal Plan M1775-12E.
Notably, the amended lot configuration resulted in an approximate 170 metre
section of road coinciding with Easement B on RP177295. It also resulted in an
increase in the number of lots/future dwellings in proximity to the high voltage
electricity infrastructure corridor. Energex have no record of having been
afforded the opportunity to provide further comment on this amended plan,
despite the obvious conflict between the development and Energex’s interests
on the site.
The amendments outlined in the point above, being the road within Easement B
on RP177295 and the increased number of lots/future dwellings in proximity to
the high voltage electricity infrastructure corridor are maintained (with some
changes) in Proposal Plan M1775-13E submitted as part of the subject Change
Application. Energex is unsupportive of the proposed lot configuration on the
following basis:
1) As noted previously, Energex’s referral agency response dated 29
November 2006 provides in principle support for a perpendicular road
crossing only. Such a design outcome is considered appropriate, as the
impacts to Energex’s electricity infrastructure and easement rights are
suitably limited and/or managed. The amended proposal, including
approximately 250 metres of road within Easement B on RP177295,
involves additional impacts on Energex’s interests, for which insufficient
information has been provided; and
2) The lot configuration shown on amended Proposal Plan M1775-13E results
in a total of eight (8) lots directly interfacing Easement B on RP177295,
being Lots 27-29 and 35-39. There is insufficient information provided to
demonstrate the concept of prudent avoidance for future dwellings on these
lots, particularly those with building envelopes in close proximity to the high
voltage electricity infrastructure corridor (i.e. Lots 35-39). This issue should
not be deferred to future dwelling house development applications, given
their potential categorisation as accepted development, subject to
requirements.
Energex may revise its position in relation to the Change Application, subject to the
Applicant submitting an amended proposal showing a perpendicular road crossing of
the easement and/or further detailed assessment addressing the following issues:
Road Design within Easement B on RP177295
The Applicant is to provide further detailed plans/drawings of the proposed road design
that demonstrate the following:
The proposed road design within Easement B on RP177295 including a
detailed conductor survey (in plan and profile) of the development in relation to
Energex’s asset. These drawings and conductor survey are to be prepared by a
suitably qualified professional. Energex’s requirements for the conductor survey
are outlined in Attachment 2;

Statutory clearances in accordance with the Electrical Safety Regulations 2013
are maintained after completion of roadworks. This includes ground clearances
and clearances to road equipment, such as lighting structures; and
Compliance with Energex’s Distribution Earthing Manual regarding clearances
to transmission structures.
Note: the Applicant is to liaise with Energex regarding specific road design
requirements to accommodate the 132kV electricity infrastructure corridor. Where
required to facilitate the development, the Developer/Applicant will be responsible
for any design and construction costs associated with relocation of electricity
infrastructure and/or other general works on the easement.
Prudent Avoidance
The Applicant is to provide an EMF Report prepared by a suitably qualified
professional, which as a minimum, addresses the following points:
Current and future levels of EMF at the common boundary of Easement B on
RP177295 and any proposed lots;
Compliance to applicable standards for EMF with reference to ARPANSA and
other international standards; and
Practical measures to reduce EMF to demonstrate the concept of prudent
avoidance
Note: the subdivision plan is to be amended to incorporate any recommendations of
the EMF Report.
Should you require further information regarding this matter, please contact the
undersigned on (07) 3664 5097 or [email protected] faithfully,

RESPONSE TO DEVELOPMENT APPLICATION ENERGEX Limited acting as an advice agency under the Integrated Planning Act 1997, response to the proposed development is: This application be refused for the following reasons: or x This application be approved in principle subject to the following conditions: When considering any future works either on ENERGEX easements or in the vicinity of ENERGEX assets, please be aware of the following general conditions: Any further proposal for works or development on the easement including those involving changes in ground level and retaining wall designs around towers and poles must have prior approval from ENERGEX. Please submit the relevant civil design to the Principal Mains Design Engineer for approval. Satisfactory clearance from any proposed structure to the existing (and/or future) electricity wires must be maintained in accordance with the Electrical Safety Regulations 2002. No civil works are to occur within 5 metres of any part of a tower base, pole or stay. Trenches in excess of 5metres in depth must have a minimum horizontal séparation, from the trench to any tower base or pole, at least equal to the trench depth. Natural ground levels on the easement should not be disturbed without ENERGEX approval. ENERGEX trenching requirements for the installation of pipe include full depth shoring of trench sides for 5 metres either side of a structure. The trench is not to be left open overnight and backfill is to be compacted in 150mm layers in the immediate vicinity of the structure. Final ground levels should slope gently to the edge of the easement, surrounding area or kerb such that pooling of water on the easement is avoided and conductor ground clearances are not decreased. 10 metres clear access must be provided around all towers and pole structures. Stockpiling of spoil on the easement is prohibited. Lighting structures are not permitted in the easement without prior written consent of ENERGEX. Underground services should be kept to the outer edge of the easement and any crossing of the easement should be clearly marked. Please submit the relevant design drawings to the Principal Mains Design Engineer for review. The identification, assessment and mitigation of any possible hazards in the service due to electromagnetically induced voltages, is the responsibility of the developer. Any cut in the vicinity of a structure or between a structure and the road kerb will need to be stabilised by a retaining wall. The retaining wall design and location is to be submitted to ENERGEX for approval. Reference: HBD313709 - (710/23/11 P23-02) — L1167

e Access to the easement and access along the easement must be available to ENERGEX personnel and heavy equipment at all times. ENERGEX will require the developer / owner to supply and install gates where fencing prohibits access to and along the easement area. To enable travel along the easement at anytime the gates must be series locked with an ENERGEX padiock. Both the padlock and a design drawing of an acceptable gate will be provided by ENERGEX. e Any costs incurred by ENERGEX as a result of the works on the easement are to be met by the property developer / owner. e At ail times the following clearance must be maintained from the top of any machinery moving in the vicinity of energised conductors: * 132kV and 110kV conductors — 4.5m minimum clearance © 33kV and 11kV conductors —- 3m minimum clearance Should it be necessary to transport equipment or extend any equipment, such that these clearances cannot be confidently maintained, you are required to contact our office to ascertain whether a Safety Officer is required on-site. All operators of machinery are to be made aware of the presence of high voltage conductors. e« Any proposal for landscaping on the easement must have prior approval from ENERGEX. Please submit the relevant landscaping design to Principal Mains Design Engineer for approval. When considering landscape designs the planting of trees must be kept to the edges of the easement and not under any overhead conductors. When mature, plants or trees must not grow in excess of 4 metres in height. If pertinent the ENERGEX Guide to “Powerline Friendly Plants” will be enclosed, please refer to this Guide for recommended species. Reference: HBD313709 - (7140/23/11 P23-02) — L1167
