2. SITE DETAILS
2.1. Background
On 21 October 1999 Council approved a development application (12637 DA) for an Integrated
Permaculture Designed Organic Orchard and Golf Course (18 holes). On 19 January 2006, Council
approved an application to extend the clubhouse hours of operation to 10pm Monday to Sunday.
Notably condition 43 of the development approval requires:
43. The approval of the Sport and Recreation (golf course) component of the Integrated
Permaculture Designed Organic Orchard and golf Course Complex, is only valid for as long
as the Agriculture use (Permaculture) is undertaken on the site. The sport and Recreation
(Golf Course) use, and ancillary uses, lapse if the Permaculture use ceases on the site.
The applicant advises in this regard that …there is absolutely no question that the permaculture
use has not ceased and the orchard is not something that suddenly stops operating, but continually
produces fruit/vegetables. In addition, free range poultry and beef have continually grazed which
is part of the permaculture system, to integrate livestock and crops. The orchard and gardens
have continuously been maintained over the years and the organic produce sold locally or to
market…
In terms of the golf course use, the course and greens have been mowed up to 2 times per week
and the bunkers maintained since the use commenced…
A pre-lodgement meeting to discuss the application was held March 2022. At this meeting Council
staff raised concerns with the proposal including:
• Whether approval had lapsed
• The scale of the use and associated offsite impacts which are incompatible with the intent
      of the Rural zone
• Traffic impacts
• Use contrary to the Agricultural Land Conservation Area requirements of the Noosa Plan
• Public use of the site
• Requirements for specialist reports
